Now the purpose of the leaked conference call, aka instructions, from former President Barack Obama come into play. In a very unusual move today Michael Flynn’s judge, Emmet Sullivan, enters an order granting outside parties the time to enter amicus briefs (friend of the court) to assist in guiding the court; a briefing schedule to follow.
It looks like the judge wants to give former DOJ employees (2,000 signatures on letter) an opportunity to publicly undermine and undercut the position of the DOJ in moving to dismiss the charges. Infuriating, remarkable and transparently political.
Judge Sullivan even cited famously political Judge Amy Berman Jackson, a subtle hat/tip to President Obama’s recent May 8th instructions. Sullivan’s order can put to rest any contemplation of him holding corrupt prosecutor Brandon Van Grack to account; and only further delays removing the sword of damocles from atop Lt. General Michael Flynn.
The transparent purpose of allowing public comment, specifically from the Lawfare resistance group, is to undermine the DOJ and further create a political narrative around AG Bill Barr. However, on the positive side this might stir Barr to release even more damaging information to counter the political efforts of Judge Sullivan. Quite remarkable.

Lying about talking to the Russian ambassador is certainly not the same as levying war or adhering to an enemy, and the substance of Flynn’s conversations weren’t either. They spoke about U.S. sanctions against Russia and a UN resolution involving Israel.
The judge was quick to retreat on this line of thinking.
It seems that the judge may have been inspired by a misunderstanding of Flynn’s contacts with Turkey, which Flynn had also lied about. Sullivan said that Flynn had acted “an unregistered agent of a foreign country, while serving as the national security adviser to the president of the United States.”
A member of Mueller’s team had to point out that this was not the case, and that Flynn had stopped dealing with Turkey before he took office.
The judge begins by clarifying that he wasn’t suggesting Michael Flynn committed treason, he was asking to get a sense of offenses — “I was just curious.” Prosecutor Brandon Van Grack says the government had no reason to believe Flynn committed treason
According to Andy McCarthy, it would be difficult for Sullivan to proceed to sentencing without the support of the prosecution, thus leaving the only option of a dismissal.
I still don’t trust this creep.
The Lawfare teams’ actions are of concern to me. These groups need a big tell-all exposure.
Yep, and they know it's all about controlling the narrative on a daily basis so as to bash President Trump and keep any positive news off the idiot box and in the headlines.
That's exactly what they're doing and they have the entire news media in their pocket doing their bidding.
You and I have to win this battle on a daily basis against them in our circle of friends and acquaintances. This is a war against Democrat and media (I repeat myself) disinformation and propaganda.

The briefs will provide cover for Judge Sullivan to toss the DOJ’s motion to withdraw charges and sentence Flynn. He’ll give Flynn at least 3 years.

Discussion of ‘options’ by McCarthy and whoever else is not pertinent other than to echo the disbelief, denial, shock, and confusion.
A key analysis will focus on the Gag Order.
Flynn, once able to speak, can reveal facts and testimony that lead to or support indictments presumably leading a path to Obama.
The key then is to keep the Gag Order in place as long as possible. That translates to keeping the time to a ruling of dismissal extended out as far as possible.
Asking, receiving, reviewing thousands of amici might buy six months of delay removing a Flynn factor in the election.
The emergency appeal by the General Flynn’s attorney Sydney Powell to the DC Court of Appeals should sail through if I am correct that the composition of that court has been revamped by the Administration. Correct me if I am wrong here.
If the appeal is successful as expected. it would seem Sullivan must dismiss.
A question to ponder is whether Sullivan can leave the Gag Order in place after dismissal without delay.
In a similar kangeroo court involving Dr. Judy Mikovits, charges were dropped and a Gag order was left in place.
