Police: Man brought gun to high school basketball game (Ahmaud Avery)

BRUNSWICK, Ga. – A quick acting police officer in Brunswick stopped a teenager with a loaded gun from entering a high school basketball game Tuesday night.

Police arrested 19-year-old Ahmaud Marquez Avery (pictured below), who is not a student at Brunswick.

"The man ran through the parking lot. I tried to get him to stop as well. He would not stop for us," said Glynn County Schools Chief of Police, Rod Ellis. "We ended up chasing him to the back of the school were other officers helped us apprehend him."

Ellis said the .380 caliber semi-automatic handgun slipped out of the teen's pants.

How come the police don’t know about it?

If you are talking about the burglaries, as I said, one was reported. Another has surfaces which was not reported.

I will not be surprised if more come to light which were not reported to the police.

The court system will handle it

If you take the law in your own hands, believing a man deserves death for trespassing on a property that you don’t own and was witnessed by a neighbor (2nd hand info) and decide the man deserves the death penalty, we no longer live in a country of laws. Vigilantism isn’t the answer.

Anyone is wasting their time arguing with many people who don’t want to be perceived as racist, as if that’s going to change the growing climate of hostility from blacks who keep demanding more and more and it’s never enough.

Rightly or wrongly, Blacks stick together and don’t condemn anyone black such as in the case of Smollett lying, They actually grinned and acted like it was no big deal, and said, “Everyone tells little, white, lies”.

Half of whites today will send their kids down the river instead of perceived as “racist”.

It’s only going to get worse as you don’t get to defend or watch out for your own property, and just take it on the chin and let the police file a report while they live in gated communities and have their own security patrols.

No doubt this Ahmaud will get a statue erected to him in that neighborhood. Facts don’t matter, anymore, and even if exonerated like Zimmerman or Officer Darren Wilson, your life is ruined.

Actually ‘Citizen’s arrest’ can only be claimed in certain situations, generally violent crimes that you witnessed and you stopped the individual from continuing the violence, like a mass shooter. Or preventing a rapist from escaping or if you are a security guard at a store or mall, you can hold an individual for shop lifting, until the police arrive.

Citizen’s arrest in fact, is rarely used. Probably the most times it is ever used is in the shop lifting scenario.

In GA you need to be a witness of the actual crime and you stopped the individual and prevented his escape because you believed your life and others might be in jeopardy. You also have the duty to contact the police immediately.

The problem with these yahoos is that they admit that they never witnessed the ‘jogger’ commit any crime, so that automatically disqualifies them from claiming ‘citizen’s arrest’. Citizen’s arrest is on the books to protect people who step up to stop a criminal from leaving the scene of a crime. This way the criminal’s defense attorney can’t say his client was illegally detained and all the charges be dropped.

For example, about a 100ft in front of you on the public sidewalk you witness a man push a lady to the ground and grab her purse, he is running towards you and your friends to get away. You and your friends block him and grab him and hold him until the police arrive. That is what a citizen’s arrest is, perp does violent act, tries to get away and citizens hold him until the police arrive.

It does not give you the legal right to give chase, investigate/interrogate, demand answers, confessions, etc. That is police work. If you and your friends come across this same woman, but didn’t see what happened, you call the 911 to get her help. If you try to get it out of her what happened and she tells you a guy in a tall thin man in a black coat pushed her down and grabbed her purse and pointed to what direction he ran, you don’t have any authority to chase/find/apprehend, the suspect. That is police work.

He was defending himself from an unlawful citizen’s arrest/vigilantism

This is still America, you do have the right to defend yourself against someone who is committing a unlawful act against you.

That is what I saw.

And that is what the prosecutor and the Jury will see as well.

You see, we are a nation of laws, the law doesn’t give you or I police powers over our fellow man, that is reserved for the sworn police officers, if those officers violate those laws, they are in big trouble.

The law is the law, Citizen’s Arrest does not give the general public police powers over other citizens, it gives a limited power of detention as long as the citizen witnesses the crime and calls the police immediately.

It does not give John Q public the authority to investigate, interrogate, detain at gun point, demand answers at gun point, fire three shots at possible suspects, etc. This is murder

And sorry, I understand the victim wasn’t a model citizen and yes he is a criminal with a criminal record, but that doesn’t give anyone the right to be investigator/prosecutor/Judge/jury/executioner either.

Just look up the Georgia statute and it says;
“As a private citizen, you have no authority to arrest anyone with a warrant. Without a war- rant, you may arrest anyone who commits a mis- demeanor or a felony in your presence or with your immediate knowledge.“

So did the McMichaels have immediate knowledge? from what I’ve read their neighbor, Mr Bryan, saw Abery enter and leave the construction site. He then called George McMichael who was at his sons Terry’s house, said house is on the same street as the house under construction. Did they see him run from the site? if they did would that or Mr.Bryan’s phone call, or both those together rise to the level of immediate knowledge under Georgia law.

What I’m learning from this discussion with you is that if I ever get chased down and cut off by two men who then bail out of the truck, armed, oh and btw they’re not the same color as me, there’s only one thing to do if I want to go home to my wife alive.

One can’t outrun a load of buckshot any more than one can outrun a pickup.

The only thing to do is to close ground with the dude with the shotgun and first neutralize the shotgun as a threat. If I’m close enough to fight him in close he’s going to have a hard time shooting me... I hope.

The next thing to do is to disarm him. Easier said than done, but this is the only choice available.

The third thing to do is to engage the second guy, who appeared to be armed with a handgun, probably a revolver or so it appeared in the video which was poor quality.

Now no one wants to be in a gunfight. But there one is, it came on its own.

I would hope to have that shotgun in my hands and I would hope to find a way to take revolver dude out of the fight.

I would hope to then turn my attention back to shotgun dude, who’s laying there hurt from having just been disarmed, and if he makes a move like he’s reaching for another weapon I would hope to deal with him likewise, without hesitation.

I would hope to then wait for the cops and to say nothing except I want to call my attorney.

Yes, it’s easy to talk valiantly but these two guys who aren’t the same color as me chased me down and bailed out of their truck aggressively with guns, and that’s the way I would hope to respond. Maybe go home to my wife, or maybe die fighting.

Otherwise those two guys who aren’t the same color as me are going to shoot me and throw my carcass in that truck and my wife will never see me again.

Your buddies are going to prison forever.

That isn’t an example of immediate knowledge though.

Immediate knowledge would be, using my example of the purse snatcher above, would be if you were looking down at your cell phone and you hear “Stop Thief” being shouted, you look up and you see a man running with a purse, that would be immediate knowledge, even though you did not witness him take the purse, you saw him with the purse, the woman on the ground and him running towards you so you stop him and held him until police arrived.
