Trump admin urges US court not to block work permits to spouses of H1B visa-holders

In a major development, the Trump administration has urged a federal district court not to block an Obama-era rule allowing certain categories of spouses of H-1B visa-holders to work in the US.

In a submission before the US District Court, District Washington this week, the Department of Homeland Security (DHS) argued that the American technology workers, who had challenged the 2015 ruling on giving work permits to H-4 visa-holders, have not been irreparably harmed by such work authorisation.

An H-4 visa is issued by the US Citizenship and Immigration Services (USCIS) to the immediate family members (spouse and children under 21 years of age) of the H-1B visa-holders, most of whom are Indian IT professionals. It is normally issued to those who have already started the process of seeking employment-based lawful permanent resident status.

The DHS, in its submission on May 5, said the argument by Save Jobs USA on behalf of American technology workers “only speculates about potential economic harm to its members, based on five-year-old affidavits”. In its lawsuit filed in 2015, Save Jobs USA had argued that the regulation issued by the Obama administration to provide employment authorisation for certain H4 dependent spouses harms their members, who are American technology workers.

Trump is going to need every vote he can get, and this kind of crap is NOT going to help him. To hell with these smelly unwashed foreign H1B scabs. Send them all back. American jobs for Americans ONLY!

Boo this sucks. H1Bs need to stop. Any H1B from China needs to be immediately told they need to go. This is insanity. By laws Chinese nationals are supposed to commit acts of industrial espionage. How about H1Bs for attornys I bet that profession is excluded from having their piece of the pie encroached upon.

Not just American Technology workers but all American workers are harmed by H1B and H4 visas and we now have an unemployment rate at over 20% . Trump ran on America first. This is very disappointing .

My sister and brother-in-law lived in Singapore for two years. She was absolutely not allowed to work or volunteer for any jobs.

If these H1-B aliens are allowed to come to the USA and take TWO jobs from Americans. It is not fair to US citizens.

Well Trump did toughen the H1B recertification requirements making H1B renewals very difficult to get, so this court case for all practical purposes may be moot. He’s been a lot tougher on H1B abuses than past presidents. Still, it would be nice if the government took the correct position here.

Do you know who Tucker Carlson was referring to last night, when he kept saying “you can guess who”?

The context implied that when Mike Lee and other advocates of the H1b visa program call the White House they find a sympathetic ear - “you can guess who”. The implication was that there was someone in Trump’s inner circle who is a bad influence when it comes to H1b visas.

What is the back story here? Who do you think Tucker was referring to and why not just say the name? Why the mystery? Is it Ivanka, Jared Kushner, Chad Wolf, or who?

I guess I have tended to discount the “palace intrigue” rumors regarding Ivanka, because I never know what to believe. I know there are trolls and never Trumpers who always like to suggest the Trump administration is in turmoil, and that President is unduly influenced by those around him. So I take a lot of these stories with a grain of salt.

But having said that, I am curious to know who Tucker Carlson was referring to - if you could hazard a guess.
