So is this better/worse than if Judge Sullivan had made the ruling?

So, with no judgment, they can re-open it at a later date?

I think that there should be a huge apology before this, one long and drawn out...

I'm guessing it's better in some respects, and worse in others.
Flynn might have been better equipped to pursue a civil lawsuit if the judge had ruled in his favor on the matter.

“The Justice Department said it had concluded that Flynns interview by the FBI was ‘untethered to, and unjustified by, the FBIs counterintelligence investigation into Mr. Flynn’ and that the interview on January 24, 2017 was ‘conducted without any legitimate investigative basis.’

I don’t know if it’s possible in this case, but this should be followed by the biggest wrongful prosecution suit in the history of man.
To: RaceBannon
Hallelujah!
There should still be a full accounting of how/why this happened from start to finish.
It should also be apparent now that the convictions against George PapaD should be vacated for the same reasons. They clearly tried to entrap him with the 10k cash payment.
Manafort was convicted on old charges that preceded the Trump campaign even though those were declined for prosecution prior to Mueller.
The indictments of the Russian Troll Farmers were an epic failure.
This leaves Stone.....

I’m hoping that statement is read as a massive admission of liability in a civil lawsuit.

Perhaps, but Flynn’s lawyer should have no problem making the case on a preponderance of evidence standard.
Would have to think that DOJ and his prior lawyers will settle out of court. They can’t be that stupid. Write the check now and avoid even more painful discovery.
