HONOLULU In the case of a bar owner who was assaulted by a homeless man illegally living in a nearby storage unit, the Hawaii Supreme Court ruled, May 5, 2020, that plaintiffs can recover damages in public nuisance suits if they have suffered individualized harm.

There have been born and raised HAWAIIAN homeless for decades, even before other states sent theirs to the islands.

Finally a court in Hawaii that knows the law and doesn’t let the Left get away with proverbial murder. Time to clamp down on the Marxists and fake Hawaiians who are trying to stop the building of a new telescope complex (if they haven’t already built it. I’m a lot behind in Hawaiian affairs).
Maybe this can evolve into something good, as Freeper Veggie Todd is suggesting. What if Federal Courts were to start ruling that victims of illegal aliens can start suing those who enable illegal aliens to stay in the United States?

I hand out gospel tracts to the homeless, feed them snacks daily, buy meals on occasion, even hotel rooms for a few during the winter.
I agree, but not letting them reduce themselves to human waste in a gutter expecting them to come to their senses while rolling in their own excrement is a form of enabling, but who defines enabling?
And by the way, many are doing just what I just said...not a joke.

Or the politician who insist they have a right to squat on other people’s property?

Are soup kitchens enablers?
Or are sidewalk missionaries enablers?
Nope, giving people money has no bearing on the homeless' right to squat. The local government gives them a pass.

Yes, that's the first line of culpability. And when local law enforcement is called to enforce homeless laws, and nothing is done, the chief of police and the mayor of the town are next.

Of course not. Do you think only homeless people get food from food banks?

Of course not again. Do you think only homeless people get served at soup kitchens?
Or are sidewalk missionaries enablers?
No. Trying to help someone spiritually is not enabling homelessness.
He sued the owners of the storage units. They were letting the homeless live there in contravention to local laws and thereby creating a public nuisance.
This has nothing to do with the social enablers of homelessness.
Ah, I knew it was too good to be true. Now property owners are going to be between a rock and a hard place. If they try to run these bums off, they will be in trouble with the ACLU. If they don’t, they might get sued. Welcome to the new USA. In the good old days, the cops could run them out of town and keep them from loitering in public places. When did it become a right to sleep, pee, and pooh anywhere one felt like doing it? Or hang out in public libraries and foul up the place?
The welfare system enables addicts and other bums to live the life they choose. There is no incentive for these people to clean up their act. The mentally ill are another problem, but it isn’t solved by letting them live on the streets, either. If we didn’t have a giant, expensive system enabling people to be bums, and only had private charity, then the poor could be helped and the shiftless would have to find another way of life.
Yes, anyone who does not demand some sort of accountability is an enabler. If people are just feeding the homeless with no expectation that they will attempt to change their situation, then it is similar to feeding the bears in the national parks. It facilitates their journey on the road to ruin. For those who are mentally ill, they need more than just food and are not helped by being allowed to live on the street.
These issues are never easy to deal with, but continuing to support people to live like this isn’t helping anyone.
