GILPIN COUNTY, Colo. (KDVR) Gilpin County closed all county roads to non-residents on April 16 in order to reduce the spread of the coronavirus.
The public health order was established by the Gilpin County Board of Health in response to the amount of people ignoring the stay-at-home order and traveling to the high country.
With this many people coming to our county, there is a much greater risk of the virus spreading and increasing the rate of transmission of the virus, Board Chair Gail Watson said.
Gilpin County only has one confirmed case as of April 19, but they are being proactive to avoid that number increasing. . . .

Yeah, I don’t think this passes Constitutional muster. And anyway how do they know if you are from the county?
Just tell them cops youre an illegal alien.

Can a county legally restrict travel on a state highway or a federal highway?

And what if it’s an emergency? Then what?
I smell huge lawsuits.
Dress the wife in a burqua and drive around randomly, just for fun.
Lots of back roads around there.
There would have to some sort of county sticker on your car for them to know without stopping you first and asking.
Otherwise I don’t see how they would know.
Further on in the story, the State Park is open but the county is restricting its use to only residents. I’m no legal eagle, but not sure how this would be defensible in court.
“Gilpin County is home to Golden Gate Canyon State Park which is still open for hiking. Only residents will be able to utilize the parks non-campground outdoor space until the order is lifted.”
There was a county police department in North Carolina that was stopping nonresidents from accessing the Outer Banks. There was a flood of outsiders from NYC, Philadelphia and D.C. traveling there to escape the lockdown orders in their home regions. The police departments rationale seemed reasonable: We cant have people flooding into this place from known COVID-19 hot spots. Our hospitals and other medical services arent equipped to handle more than a couple of dozen patients at a time.
And anyway how do they know if you are from the county?
Under what law are they allowed to do that?
Sheriff Buford’s “Y’all do what I say and shut yer damn traps or I’ll give ya somethin’ to whine about!’” regulation?
The scenario you describe there is exactly why New Jersey locked down so many of their public places. They couldnt handle the flood of people using their parks from neighboring New York City.
We discussed this topic at great length back in the February CV threads.
Bottom line—the County Health Officer (whatever they are called in the particular county) have very wide powers in the event of an epidemic.
These are ancient laws which have not been used since 1918.
Here is one example from that period:
Those “outsiders” own property there and were headed to their own personally owned houses. Keeping them out is pure tyranny.
Quarantines are supposed to impact sick people, not imprison and restrict those with no evidence of illness.
