A new rule issued by the Department of Homeland Security (DHS) and the Agriculture Department (USDA) allows H-2A foreign visa workers to remain in the United States for longer than three years.
Acting DHS Secretary Chad Wolf announced on Wednesday that the agency, in coordination with USDA Secretary Sonny Perdue, will allow American farms to hire H-2A foreign visa workers who are already in the U.S. — bypassing existing rules that require them to hire incoming H-2A foreign visa workers.
The H-2A program allows American farms to import a limitless number of foreign workers and pay them below-average U.S. wages. American farms do not wholly rely on H-2A foreign visa workers to fill agricultural jobs, as the foreign workers make up only about ten percent of the total U.S. crop farm workforce. Last year, U.S. farmers hired roughly 250,000 H-2A foreign visa workers.
The DHS-USDA rule means that H-2A foreign visa workers can stay in the U.S. beyond their three-year residency period without ever having to return to their home countries. [...]
“Providing flexibility for H-2A employers to utilize H-2A workers that are currently in the United States is critically important as we continue to see travel and border restrictions as a result of COVID-19,” Perdue said in a statement.
The rule comes in addition to the State Department’s decision to waive certain visa requirements for all H-2A and H-2B foreign visa workers. The State Department waiver means U.S. employers can fast-track foreign workers with no increased medical screenings while at least 10 million Americans file for unemployment. [...]

In other words, allows workers already here to be hired for another season, rather than promising them they can stay another 3 years.

Just had a screaming match with a supervisor of one of the Indian recruitment firms, LanceSoft, calling from Virginia and then from
San Diego who demanded I submit scans of my SS card, a recent photo and my drivers license, in violation of maybe 5 or 6 US laws on this.
Work Location: Dallas (Plano), TX, so Im guessing InfoSys, who paid out record fines for doing the exact same thing before.
Instead of stepping on that slippery slope, let's hire Americans at the American market wage, i.e. as much as it takes to get Americans to show up and do the job. Foreign labor is welfare for inefficient producers.

Yep. Just had a call from a American VP from LanceSoft. All phone-based recruiters are based in India. In fact, thats how a vast majority of recruitment companies work. Small admin office in USA, all recruiters calling from a call center in India using VOIP. Thats why the lines are so bloody awful.
Sorry, any picture ID at any time prior to giving express written information permission for an employment screen is a violation of civil rights and EEOC policy - especially those over 40. Thats why American companies dont require it and dont even DOB or full social on the initial application.
With your month and day of birth, your last 4 and a photo, the other information can be obtained or generated. When SSNs were only previously required prior to working, many including myself, got in in our hometown. Thats the other 5 digits right there. Same with license number in some states, can be reverse engineered. Did it when I needed a copy of my DL records and forgot my old DL number. Used an online generator, used that number and it was the same as the official, real one when my driver abstract was mailed to me.
