Governor's Coronavirus Order 'Bans Homeschooling' Critics Blast Back: Parents Have a Fundamental Constitutional Right to Raise And Educate Their Children

Michigan Democratic Gov. Gretchen Whitmer's order closing public school buildings also bans homeschooling, which is unconstitutional, contends a legal non-profit in the state.

"The Great Lakes Justice Center calls upon Gov. Whitmer to correct this unconstitutional action and assure parents in Michigan that they may continue to safely home school their own children while the EO is in effect," the organization said in a statement Thursday.

The April 2 order states "in-person instruction for pupils in kindergarten through grade 12 … is suspended for the remainder of the 2019-2020 school year."

It applies to all "non-public ... schools in the state."

"The governor clearly has the authority to close school buildings," the legal team acknowledged. However, "Michigan law defines home schools as nonpublic schools."

That means the executive order bars parents from directly teaching their children at home, the organization argued.

"While this may be an unintended consequence of faulty drafting, the EO's plain language bans all 'in-person instruction' of all children."

No. Home schools are “non public schools” under MI law. This type of issue is a common approach to infringing on home schools.

This was likely aimed at private and parochial schools, but the legal language says exactly what WND is reporting.

Here let me help you past the cliches.

1. We had 8 years of a GOP governor. It was the usual fatigue of one party having the office leading to a switch.

1.5 The then Lt. Gov (the nominee) didnt really move people.

2. She ran on the platform of “fixing the damn roads”. Michigan’s roads are very poor, and it was a platform that resonated.

3. Flint

4. It was a mid-term election year. That played against the GOP.

5. The GOP dominated the House, Senate, and state high court, so there was not that sense she could do much damage. That left a lot of voters without any real sense or urgency.

So how is the Dear Leader in Michigan going to stop parents from home schooling? Those parents who actually care about their kids' futures are already home schooling and understand that they don't run to the state for everything and those who were nervous about it are seeing that they can do it and some will continue and not send their kids back to juvenile day prison again.

MI Governor Gestapo Gretchen Half-Whitmer (D) has:

Banned open burning statewide (backyard fire in fire bowl or pit).

Banned motor-boating (the kind with a boat and a motor, she likes the other kind I’m sure).

Set a 9 pm to 6am driving curfew (unless you have papers).

Banned non-essential purchases in stores, like garden topsoil and seeds and plantings (aisles blocked off).

Banned parking lot church services.

Now banned home schooling.

Deemed Michigan lottery and lotto sales essential.

I understand your position, and constitutionally I agree. However, it is still common practice in lefty states to write legal language in such a way that allows lower level apparatchiks apply it unconstitutionally until they are slapped down by the courts.

I’ve seen this approach used extensively in New York.

I was biking around the metro park today and saw two metro park police pull into the boat launch area and make a guy putting in to go fishing with an aluminum boat small motor pull it back out and leave.
