An Antioch man who attacked the owner and two employees of a San Francisco jewelry store over a belief that they’d overcharged him was denied a new trial.
Barry White Jr., 29, argued through his appellate attorney that his convictions for murder and attempted murder should be overturned in part because of a juror misheard White’s attorney and falsely believed he had made a sexist remark. The appeals court also denied White’s contention that the trial court had withheld records about police officer witnesses that would have benefited the defense.
In 2013, White entered San Francisco’s Gift Center & JewelryMart, waited for customers to leave, and attacked the staff. He shot and stabbed Lina Lim, 51, and store owner Victor Hung, and slashed the throat of Khin Min, 35, cutting her from ear to ear. Lim and Min were killed; Hung survived.
White was apparently angry because he thought he had overpaid for a chain he’d purchased from Hung days earlier.

Now if that policeman had been a better marksman these two murders could have been prevented. But then at that time the Black Lives Matter crowd would have raised holy hell and his family would have sued the city for millions of dollars.

Well. if he didn’t really make a sexist remark while he was slashing the guy then he should walk. For a sexist remark, though, he should surely have got the death penalty.

I handle it a bit differently. I was a carney for a while and learned to spot a short-change setup and operation. I got shortchanged in a Burger King- change for a 5 instead of the 10 I handed over. It was a carefully set up operation. When I asked the clerk to check in the drawer to see if there was a 5 on the stack of 10s, she opened it and there was only one stack of bills with all denominations. I called for the shift manager who came out, took the drawer back out of sight, returned and said she counted it and all was correct. At that point I turned and left. I called another BK and asked for the district manager’s phone number. The clerk there asked why. I explained and he said sure. I described the little song and dance to the DM and she said she would make it good. I went back to the BK next day and the two employees were gone. Three days later I got a 5 dollar bill in the mail from the DM.
San Francisco prosecuted for mere murder?
