Supreme Court Rules Illegal Aliens CAN Be Prosecuted For Identity Theft

In a 5-4 decision, a divided U.S. Supreme Court ruled that foreigners who are in America illegally can be prosecuted for the crime of identity theft.

While the ruling seems like a no brainer, the court was divided because the case involved the Immigration Control and Reform Act, which says any information provided on an I-9 work form can’t be used by law enforcement in any way — and that includes as evidence in a criminal case.

“The Immigration Control and Reform Act (IRCA) makes it a federal crime to lie on the I-9 work authorization form, while limiting how the false information can be used,” Fox News reported. “Federal law also says information “contained in” the I-9 cannot be used for law enforcement other than specified exceptions — but the Supreme Court ruled that if workers use the same information in tax documents, they can face charges.”

“Although IRCA expressly regulates the use of I–9’s and documents appended to that form, no provision of IRCA directly addresses the use of other documents, such as federal and state tax-withholding forms, that an employee may complete upon beginning a new job,” Justice Samuel Alito wrote in the court’s majority opinion. He was joined by fellow conservatives Clarence Thomas, John Roberts, Neil Gorsuch, and Brett Kavanaugh.

The IRCA also forbids state charges or civil cases against “those who employ, or recruit or refer for a fee for employment, unauthorized aliens,” but Alito noted that this “makes no mention of state or local laws that impose criminal or civil sanctions on employees or applicants for employment.”

Expect meat and veggies to get A LOT more expensive if this is actually enforced.

I haven’t seen a majority English speaking pack line in decades.

A lot of big companies have been running slave labor under the cover of “privacy” and not looking into identity theft. Now they are looking at a major disruption.

Oh, I agree.

I saw a slave shanty town next to a packing plant in Nebraska. Made me so mad I no longer buy meat from a big box store.

We will pay more, but we have been in other ways.

5-4 how the hell is this a close decision? I do this I get prosecuted but according to the treasonous rat Justices if I am an illegal doing the same thing I don’t. Democrats are a clear and present danger.

Many across the political spectrum tend to forget what makes Americans unique: we are by far and away the most ambitious, hard working people on the globe. And it's not just because we're so "special"; no, rather we're descendants of those who couldn't passively abide remaining in their home countries.

Some % of illegals are no different - there is a significant number who work hard and have that unique, intrinsic focus. So, what does this mean? It means NIMBY - everyone wants to get in, but once there, they want the door slammed shut on everyone else. Why would anyone think illegals are any different? Their wages too are driven down by even more recent arrivals.

Then, consider that fed.gov (along with state & local government) is like the Borg: everyone gets assimilated. By that, I mean becomes a cog in the insatiable tax machine. Sure, at first it's easy using the system, but what happens as illegals' earnings increase and they begin buy cars, houses, etc? Yep, they're in the same boat as everyone else. And what about those who are hard working and banking some income? Think they **want to give it away** to more recent illegals?

Many immigrants are just like young people - fashionably liberal until they start paying into the system. And that's what creates the inherent problem with the proglib strategy - they need a constant infusion of new illegals, new poor people, new dependents on gov't largess. But that's not how human nature works. That's why the Wall is ingenious - prevent 99.9% from getting in, so that the .01% are the ones we want.
