Stone files motion demanding judge recuse herself from ruling on new trial request

Attorneys for Roger Stone late Friday filed a motion arguing the federal judge who sentenced him to more than three years in prison should recuse herself from deciding his request for a new trial.

Defense attorneys said Judge Amy Berman Jackson’s statements just before sentencing Stone Thursday afternoon show she’s already made up her mind about whether a juror was biased against the longtime GOP operative.

Stone is seeking a new trial based on social media posts by the forewoman in his trial, Tomkea Hart, saying she never should have been allowed on the jury because of Twitter posts mocking Stone’s arrest. She has also called Trump supporters racists.

Moments before Judge Jackson handed down Stone’s sentence on Thursday afternoon, she praised the jury for their work in the case.

While accusing Stone’s attorneys of raising a “Who cares?” defense, Judge Jackson gave a lengthy speech expressing her disgust with that argument.

“The jurors who served with integrity under difficult circumstances cared. The American people cared. And I cared,” she told the courtroom.

Stone’s legal team says such emphatic statements prove Judge Jackson has prejudged his new trial bid.

“The Court’s ardent conclusion of ‘integrity’ indicates an inability to reserve judgment on an issue which has yet been heard,” his attorneys wrote in a filing just before midnight Friday.

“The premature statement blessing the ‘integrity of the jury’ undermines the appearance of impartiality and presents a strong bias for recusal,” the continued.

Ms. Hart, a former Democratic congressional candidate and anti-Trump activist, has become a focal point for Stone’s supporters.

President Trump weighed in this week saying she should have been barred from sitting on the jury.

Definitely a change of venue would be needed. The Federal District Court for DC has NINE OBAMA JUDGES including the chief judge. Probably none of those would not have an agenda. Perhaps not as bad as Uber-Agendanista Amy Berman Jackson but all pretty bad.

Sadly he’ll likely get neither a replacement judge nor a venue change,

I think that we all know where Chief Justice Roberts is on this.

As to the AG Barr, who knows?

One thing that I keep telling myself is that we did NOT get to this point overnight and due to the efforts of just one man. This Swamp has been the result of years of effort by a cast of thousands in DC.

It’s going to take more than President Trump and a handful of real Patriots one term in the White House to UNF**K this mess. There’s no magic wand available.

She did. She kept the gag order on after the verdict. I don’t think its fair. But he has to fight it now. More legal fees.

“Evidently, in the judge’s mind, bad actors like Stone are the only reason why Team Mueller and congressional investigators failed to find what Schiff repeatedly assured the public was convincing evidence of collusion. Jackson told the courtroom prior to her ruling that Stone’s deception “led to an inaccurate, incomplete and incorrect report,” by the Republican-led House Intelligence Committee.”

“In a statement by email, Jack Langer, a spokesman for Nunes, told me: “Our 240-page report has precisely one sentence that may be inaccurate information provided by Stone. That line had no impact on any of the report’s findings whatsoever.”

How was Tomeka Hart selected to be on a D.C. jury? I thought she was from Memphis. Or is it formerly Memphis and she moved to D.C?

I am confused. Your appeal has to go through the presiding judge? Shouldn’t it be appealed to a higher court?

Hope she doesn’t recuse herself. It’s another ground for appeal. If they replace her, a new judge won’t grant a new trial. That’s the way the judges are.

Amen to that. There are way too many coincidences that pop up with the deep state. Those doing the deciding are either the same people over and over or it's their spouse, sibling or co-conspirator.

In a country of 330 million why is it always the same villains making the decisions? It's kind of like a cop show based in NYC where the heroes are on the scene, in charge, within minutes, regardless of whether it's in Queens, the Bronx, Brooklyn or Manhattan.

But you are correct, she is compromised now and must stand back.

Can she be forced off the case? Does it have to be referred to a higher judge to force her off the case?

She deserves to be impeached, removed from the bench and then disbarred. After that, she needs to be investigated and tried for her crimes against the constitution.

Get a damned rope!

Sounds exceedingly fitting, to me.

Justice is impossible without an unbiased judiciary. I would make proven judicial bias punishable by imprisonment of the judge for at least 5 years - without parole.

Agreed. But I don’t think that’s sufficient. Fine them up to 3/4 of their wealth & half their retirement, or more.

It will be far better for Stone if the judge stays in the case. A new judge is highly unlikely to do anything to embarrass this judge. That’s how it works. Also, forcing a judge to recuse is very difficult.

Far better for appeal if she stays. Or for Trump’s pardon.
