I firmly believe that libel lawsuits must be revived as the sovereign remedy for leftist propaganda. In 1964 the Warren Court (Justice Brennan writing for a 9-0 majority with enthusiastic concurrences) made the novel assertion thatIt accuses Ms. Warren and Mr. Buttigieg of actual malice, a prerequisite to win a libel case if one is a public figure.". . . libel can claim no talismanic immunity from constitutional limitations. It must be measured by standards that satisfy the First AmendmentAs Antonin Scalia pointed out, that was novel because before 1964 the First Amendment was never understood to touch laws against libel (or, for that matter, pornography). Why?The reason the Bill of Rights was added to the Constitution by amendment was that the Antifederalists demanded it; the Federalists viewpoint was that since rights were matters of common law, our rights were nowhere comprehensively enumerated, and it was a fools errand to attempt to compose such. The sentiment is codified in the Ninth Amendment, "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
So the fact that right to sue for libel was not explicit in the Bill of Rights does not signify that libel law is modified in any way. The issue is whether the freedom . . . of the press is abridged by libel law. And Scalias answer is an emphatic no. He explains that freedom of the press would have meant one thing - but the freedom of the press means something different. The freedom of the press is freedom as it already existed, with existing limitations for libel (and pornography restrictions).
Scalia explained that the need of the Federalists was for a bill of rights which would not be controversial. They werent out to modify the rights of the people, but to assure that those rights were not modified. Scalia explained that the rights enumerated in the first eight amendments were only those rights which had historically been abused by tyrants.
Both defendants, Buttigieg and Warren, are alleged in the complaint to have acted with actual malice, as it is widely known that Zimmerman was acquitted of murder based on self-defense, the announcement said.
Certainly the actual malice should be easily met in this case, but the requirement for meeting that test is illegitimate, since the New York Times Co. v. Sullivan decision which requires it is not good original intent law. Beyond that, how is George Zimmerman a public figure? Did he ever run for office? All he did was defend his life, and get savaged in the press for exercising his right. George Zimmerman is an actual human person, not a stereotype.
This won’t get to trial.
And if it gets far enough along for discovery to be a concern for the plaintiffs, they’ll settle.
