I don't understand what your link has to do with anything. This isn't about judicial review of the impeachment process, it's about the President's right of access to the courts.

Schiff isn't talking about judicial review. He's talking specifically about why the House didn't call witnesses in their own hearings.

Schiff said that the President would assert executive privilege and the House would have to sue to get a court to decide, and they didn't want to spend the time to do that (they actually sued and then retracted the suit).

It appears that their strategy became to pressure the Senate to call the witnesses that the House declined to call. They pressured the wobbly Senators to vote with them. Sekulow said that it would be for naught because the President would still exert executive privilege and seek the courts for a decision. Sekulow said this would be the same thing that the House decided to pass on, but now they want to do it in the Senate. Nothing else changed about the President's claim of executive privilege, just the venue in which it's being claimed.

When that failed (as appears likely), the House managers moved on to suggesting that the Chief Justice decide whether to allow the witness to be called. He dared the Trump legal team to accept.

Again, it's not anybody's right except the President to waive executive privilege. The Senate cannot vote it away, and the Chief Justice cannot unilaterally decide it away. The President still has the right of access to the courts to litigate his claim of executive privilege there. If the courts decide he has to respond to the subpoena and he still declines to, then that's a different matter.

The problem for Schiff is that if Trump exerts his rights to the fullest extent of the law, it will take too long for the Democrats' purposes, which is why we're seeing this trap being laid out right now.

No....it’s what the Dems motion is asking for...however when the pres. Attorneys were asked by the Dems if they would agree....they said NO!!!! I loved it.

Experts say prior Supreme Court decisions would offer scant guidance on resolving an assertion by Trump of executive privilege, and that, procedurally speaking, the Trump impeachment trial has entered uncharted waters.

I think articles like this sidestep the critical issue, which I detailed in my other post.

Do you think an impeachment trial has the power to strip the President of his own legitimate rights? Just because the venue is now the Senate trial, doesn't the President have the same right of access to the courts as he did when the venue was the House committee hearing?

Just because the Chief Justice is presiding doesn't automatically vest within him the entire authority of the Judicial branch. The President still has his constitutional right of access to the entire legal system to make his claims.

Wouldn't you agree?

As I understand it Roberts can choose if the witnesses are relevant or not to the case...if in fact they vote for that motion Friday...I understand Trumps team would not agree to this saying NO!... via I think Sekulow.....

They simply shouldn’t do so Imo...this is a play by the dems big time...if they agree to Roberts being ‘the decider’ then it’s also a certainty there WILL be witnesses which shouldn’t be.......and further rules will have to be set and all the other “time stealing” tactics will come into play the Demorats are smacking their lips for.
