Following the president's defense team's presentation on Saturday, Sen. Ted Cruz (R-TX) appeared on "Justice with Judge Jeanine" to discuss what he saw and his expectations for the trial's future.
"I think it was gratifying that, number one, it was the first time the president has had his legal team to defend him," Cruz explained. "Throughout this whole proceeding in the House, they wouldn't let the president defend himself. Finally, today, we got that."
"Secondly, I think every senator is grateful for the neverending argument, the 24 hours of nonstop from the House managers, is over," the Texas senator said. "As their closing argument ended last night, I sense, and I think the sense of a lot of people, is they failed to prove their case. Today, I think, the president's lawyers did an effective job pointing out just how selective the Democrats'] quotations were from the record, how much they left out."
Cruz said he's looking forward to Monday's hearing when President Trump's defense team gets to present "the principled defense."
"What I really hope to hear from them is a substantive defense on the merits, that lays out the case, on the facts, for the president's innocent," he explained.
Cruz said he believes House impeachment managers "made a critical mistake because the central element of their argument is the proposition that [the call] was baseless, that it was frivolous, to want to investigate Burisma, the Ukrainian natural gas company, and whether or not Joe Biden and Hunter Biden remember [Burisma] was paying Hunter a million bucks a year and Joe Biden pressured Ukraine, threatened a billion dollars in aid, to force Ukraine to fire the prosecutor who was investigating Burisma, the company that was paying Hunter," Cruz explained.

Good stuff, but why ar so many people omitting that the call transcript clearly referenced CROWDSTRIKE as the target of Trump’s request with only a later mention of Biden?
Also, why not a motion to dismiss with prejudice for prosecutorial misconduct in the house?

It saddens me how conservatives still don’t get it. How many times have we taken well reasoned arguments to the courts based on law and precedent only to lose? Does anyone honestly believe any Democrat was moved by the president’s defense team? The left does NOT care about reasoned, logical points or even the benefit of the doubt.
We might as well have them vote right now, because I doubt very much the president’s defense team will change any minds. The only reason I guess it should go any further at this point is to change the minds of a very small number of voters who might still be watching this farce!

And what does that have to do with Cruz being exactly right on “proceeding to final judgement to acquit”?

YOU MISUNDERSTOOD HIS STATEMENT.
Ted has a pod cast called ‘Verdict with Ted Cruz.’ It breaks down the impeachment, and the strategies. They are all about 30 minutes each, and really informative.

Ted has a much better understanding of the law and grammar than you do!

You misread what he said. He said no such thing. And it’s “prosecution”, not “persecution”..
The Senate will vote to acquit. So the defense has two options:
1.) Vote to acquit without rebutting the lies and calumny the democRats have been floating out onto the public consciousness for months.
2.) Vote to acquit after having destroyed the lies and calumny with the facts.
Some may say there’s a third option — to call witnesses — but that option is fraught with danger and will only serve to drag the impeachment trial out for years.
I expect President Trump to be acquitted before the week is out, next week at the latest.

My first thought as well. It’s not the defense teams job to “prove” Trump’s innocence, only to cast doubt on the evidence that supports his guilt.
First, there is none of the latter only dubious implication, innuendo and hearsay all of which the defense have nuked already.
Second, it’s now the job of defense to prove the vicious politically motivated coup attempt perpetrated by the left. There’s ample evidence to make that case.
I think that is the "affirmative defense" that Trump's attorneys referred to.

smells like deflection or misdirection of focus away from crowdstrike, even if they have to throw quid pro joe & humper under the bus.
