Hawley expects McConnell's final impeachment resolution to give White House defense ability to motion to dismiss

Sen. Josh Hawley (R-Mo.) told Axios Saturday that Senate Majority Leader Mitch McConnell (R-Ky.) is expected to present a resolution that will allow President Trump's legal counsel to motion to immediately dismiss the impeachment charges during the Senate impeachment trial that starts, in earnest, Tuesday.

"I am familiar with the resolution as it stood a day or two ago," Hawley told the news source.

"My understanding is that the resolution will give the president's team the option to either move to judgment or to move to dismiss at a meaningful time," the junior senator continued.

Hawley also said that he would be "very, very surprised" if the final resolution didn't give Trump's lawyers that ability and that he might not vote for it.

Earlier this week, McConnell told reporters that "there is little or no sentiment in the Republican conference for a motion to dismiss. Our members feel that we have an obligation to listen to the arguments."

Sure looks like the Deep State fix is in...and led by the weasel, Cocaine Mitch.

There is absolutely NO Constitutional basis for the charges and SHOULD be dismissed immediately.

The argument isn’t to dismiss, but to exonerate - something a dismissal will not do, and leave the door open for further House impeachment charges. Exoneration closes the door

Yes folks exonerate is the way to go. Remember what Pelosi said “Impeachment will be with him forever.”. Exoneration will show the joke this current sham portrays.

Article II Sec 4 clearly states....... “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors”......none of which are delineated in the House articles.

......it seems highly unlikely that the President will be convicted.........

However, due to the idiocy of Pelosi, we are at a point where the SCOTUS needs to reinforce the clear language of Article II sec 4 to NEGATE the Houses’s foolish impeachment......it is clearly unconstitutional and illegitimate.

That’s insane. By listening to arguments, it gives a measure of credibility to the trash Pelosi sent over, when there’s nothing credible in any of it. Giving it even the teeniest bit of consideration is giving “them” an inch, and then they’ll demand and grab a mile.

I think Cotton last night said that it will take some ten days or more just to get the rules done. So that is minimum. Two weeks. So “quickly” starts there.

Interesting that the GOP Senate wants actual RULES. They should adopt the rules of the House, i.e., no rules at all. Will it keep Bernie, Warren, etc., off the campaign trail or can they continue until the rules are done? Is every Senator involved in the setting the rules, or just a small committee?

I’m kinda enjoying their little battle.

You are absolutely right. You make the motion to dismiss up front in the trial. You obviously have the right to present arguments in support of your motion, which in this case would get right to the heart of the matter - the unconstitutionality of the articles failing to state a cause of action to even justify a trial on the merits. Only Senator publicity hounds want a show trial.

The question that immediately occurs to me is how in the world can Bernie, Warren, and Klobuchar say NOTHING for two weeks with cameras just feet away and Iowa looming up? No way. We are going to get some very interesting sound bites from these three in weeks to come and especially today. The Sunday shows are their last chance before the “gag” goes on.

A brief trial would be better. A quick dismissal, especially without prejudice, leaves the door open for a dem do over.

And it will be spun as hackery.

A full bore trial would be the best outcome here. Force these imbeciles to provide witness lists. The defense attorneys will have an absolute right to depose every one of them under oath (ie set perjury traps).

*Everything* will be exposed during pretrial discovery. Dems have no way out of it. They started this mess; defendant will have plenty of room.

The President also has some nice legal firepower. Google Sekulow’s history. And Derschowitz, a lifelong, outspoken, yet sane, democrat is a great choice. Not only for what he represents, but, for his deep understanding of how these loons *think* and operate.

I like the idea dismissing the impeachment based on the unConstitutionality of the Articles of impeachment. How can you impeach a President for using his Executive powers granted by the Constitution? House Democrats are insane.

Its about standing for the Constitution and due process. Bogus articles that cite no violation of civil or legal code. The Senate needs to make an example of the Democrats treachery.

They cannot do any more than they have done. Tell me what it is they have accomplished by their constant attacks, lies and mis characterizations of everything done or said during this entire sham from collusion thru impeachment? The answer is NOTHING. Have Trumps popularity or job approval numbers gone down? NO they have not and in fact they have gone UP.Has Trump been impeded in carrying out his job? Not really. The border wall is getting done, China Trade agreement and Mexico, Canada Trade agreement accomplished, economy growing, minorities experiencing the great economy as never before with employment at historical highs right across the board.

So tell us all how and to what end the lib brown shirt media will have success?

They have the ability to decide what they broadcast. They have repeatedly demonstrated they will gladly manufacture fraudulent “news”. That’s not nothing. Sure nobody believes them but they “flood the zone” with it just the same and I can’t help but notice there are no stories in the media that help Trump. I would bet we get a fake story every day with a new hair on fire source of manufactured outrage.
