The teeth in the mechanism are a familiar Trump administration tool: the imposition of tariffs in proportion to damage caused by any non-compliance.

But according to the text, if the offending party disagrees with such a result, its only recourse is to quit the agreement. There are no provisions for appeal or levying retaliatory tariffs.

Yeah, quit the agreement.

Tariffs remain, and will be increased until you scream uncle in English.

If they don’t play fair we quit and the tariffs start climbing again.

That’s the outcome I expect.

Could be. They are acting pretty squirrely already.

Did you know they demoted their official that was sent to sign the agreement, after he left China?

They may be signing, but they are not happy commie campers.

Actually, that’s the right answer. Any agreement is in the end, voluntary, and serves the interest of both parties. If the agreement no longer serves, you pull back and strike a new agreement.

That’s far better than giving over sovereignty to some arbitration court you don’t control, or binding yourself to some agreement you can’t get out of when it becomes abusive.

There will not be a unified China in 10 years.

It will splinter like the old Soviet Union. And it will be painful and Dangerous.

Yeah not a great deal. Better just keeping in massive tariffs against the cheaters.

With that said at least Trump WANTS to do something about it. The 100 in the Senate have done and likely do not WANT to do anything since they are on the receiving end of Chinese interests.

And that is exactly why Trump negotiates bilateral and not multilateral trade agreements. Sp Cheaters have nowhere to hide!

You are exactly right. Of course Trump would resume AND ramp up the tariffs. It is the tariffs which brought China to the table to begin with and has caused them no end of trouble. Businesses are pulling up their stakes in China and moving on to other countries more friendly.

The Left and their media pals are utterly devastated over what Trump has accomplished with trade and want more than anything to downplay his successes.

“Did you know they demoted their official that was sent to sign the agreement, after he left China?”

No I didn’t know and furthermore I don’t believe it. The signing of the document is a mere formality and all aspects of the agreement were determined and approved well before the signing ceremony.

“If the Party Complained Against considers that the action of the Complaining Party was taken in bad faith, the remedy is to withdraw from this Agreement by providing written notice of withdrawal to the Complaining Party,” the text states.

Hmmm...they say that as if that’s a bad thing. If China screws the pooch on this, after the November election China will see tariffs on the scale of 10. They’ve only seen up to 2 on the scale so far.

The reason I mentioned this, is that Rush made a comment about it the other day. I may not have heard it as accurately as I would have liked, but Liu He was demoted last May, or shortly before that.

From what I understand China thought he was being to much of a yes-man in the negotiations. They also thought he wasn’t being shown much respect, and was just going along allowing that to happen.

Not sure if they are still upset with him, but I guess time will tell. They’re all about saving face, so in the short term we may not hear much.

I appreciate the challenge. No problem.
