RICHMOND, Va. (WAVY) A lawsuit challenging Gov. Ralph Northams executive order temporarily banning all weapons on Capitol grounds was filed Thursday. Northam (D) signed the executive order ahead of next weeks pro-gun rally on Lobby Day.
It is unclear who the plaintiff the lawsuit is at this time but the Virginia Citizens Defense League did threaten legal action before Northam made his announcement Wednesday.
A hearing will be held Thursday afternoon in Richmond Circuit Court, according to a spokesperson for Attorney General Mark Herring.

We have a law that was passed a few years ago, that explicitly prohibits the governor from banning guns by declaring an emergency.
The only place guns are banned during an emergency are emergency shelters run by the government.
So unless they are declaring the capital grounds an “emergency shelter”, it appears this is a bad use of the “state of emergency” designation.
Note that while all the democrats were in an uproar when Trump used “state of emergency” to build the wall, not ONE Of them is calling out this inappropriate use of “state of emergency”.
