In summary, when a belligerent party attacks, a state of War exists whether or not the victim declares it. If the US was to initiate the attack, THEN Congress must declare War.

Note that no United States defense is in her bill, just defense of Iran. It's laughable that a needed fast response would have to wait to be planned until both houses of congress convened and voted to approve it.
