if he was killed in the Baghdad attack, then why did the The State Department just declare him and his brother as specially designated global terrorists a few hours ago?

Maybe they designated him as a terrorist hours before he was killed (making it alright, legally). It might even be possibly that Qais’ statements several hours before his designation (calling his militia to prepare for battle, to expel Americans from Iraq) is why he (and his no good brother) got designated.
If that is the case (Statement, designation and killing; all inside of 24 hours), then we are primed for operations over there, with a very well functioning team.
I will personally be very gratified if Qais and Laith al Khazali have been killed - they have deserved it for a long time.
