I think SCOTUS would duck it as a political question, and say it is up to the Senate to decide how to proceed. The typical remedy for a failure to prosecute is dismissal.

Every idiot with a law degree has a different opinion on the rules of impeachment. The final word will be from the Supreme Court. Trump’s legal team should petition the Court to declare his Impeachment Null and Void.
