Mitch McConnell threatens to CANCEL Donald Trump's Senate trial if 'scared' Nancy Pelosi does not hand over 'slapdash' articles of impeachment - as Speaker slams him as a 'ROGUE leader' and president gloats he will be cleared by 'default'

Mitch McConnell on Thursday threatened to cancel Donald Trump's impeachment trial in the Senate if 'scared' Nancy Pelosi doesn't send over the formal articles of impeachment against the president.

The speaker and the Senate Republican leader went to war over the next steps in the impeachment process as Pelosi slammed McConnell as a 'rogue leader' - and he blasted her articles as 'slapdash' and 'unfair.'

The dispute exploded into the open the morning after Democrats voted to impeach Trump, with the president bragging he was going to win the whole thing by 'default.'

'If the Do Nothing Democrats decide, in their great wisdom, not to show up, they would lose by Default!,' Trump argued on Twitter of his upcoming Senate trial, which is now in doubt.

Pelosi has to 'transmit' the articles of impeachment and appoint 'managers' to prosecute the president - but offered no timeline on when she would do that, saying she wanted to see the Senate's plan for a 'fair trial,' effectively holding the articles over McConnell and Trump's heads.

McConnell, who previously said he wanted to hold the trial in January, responded: 'It's beyond me how the Speaker and Democratic Leader in the Senate think withholding the articles of impeachment and not sending them over gives them leverage.

'Frankly, I'm not anxious to have the trial. If she thinks her case is so weak she doesn't want to send it over, throw me into that briar patch.'

I believe they can do that even without the articles in front of them..just hold a Senate hearing and dismiss it..game over

That is what I said yesterday but got poopooed on here at FR. I still think McTurtle can just bring the impeachment to the floor, no debate, and take the vote. Done

Not according to Alan Dershowitz...He brought this very thing up this morning on the radio...He said the 6th Amendment does apply to this impeachment....

Does, or should?

Either way, nobody agrees with him.

Of course, Dershowitz would LOVE to see judges adjudicating impeachment. He’s been a Judicial Supremacist his entire career.

But the Constitution says that the Senate has sole authority to determine its own procedures and also sole authority to try presidential impeachments.

“SOLE AUTHORITY” is quite unambiguous.

No power on earth can intervene in whatever the Senate chooses to do. There is no appeal.

Excellent point. With all the mushy talk about him sometimes talking sense the underlying truth of his being a Judicial Supremacist is still there.

It’s very interesting to note that the President has the authority to call a Special Session of Congress.

Being that Trump is a danger to our National Security and all.

I thought the same way you do. Till I saw this....

RULES OF PROCEDURE AND PRACTICE IN THE SENATE WHEN SITTING ON IMPEACH- MENT TRIALS[Revised pursuant to S. Res. 479, 99-2, Aug. 16, 1986]

I. Whensoever the Senate shall receive notice from the House of Representatives that managers are appointed on their part to conduct an impeachment against any person and are directed to carry articles of impeachment to the Senate, the Secretary of the Senate shall immediately in- form the House of Representatives that the Senate is ready to receive the managers for the purpose of exhibiting such articles of impeachment, agreeably to such notice.

II. When the managers of an impeachment shall be intro- duced at the bar of the Senate and shall signify that they are ready to exhibit articles of impeachment against any person, the Presiding Officer of the Senate shall direct the Sergeant at Arms to make proclamation, who shall, after making proclamation, repeat the following words, viz: ``All persons are commanded to keep silence, on pain of imprisonment, while the House of Representatives is exhibiting to the Senate of the United States articles of impeachment against ------ ------''; after which the articles shall be exhibited, and then the Presiding Officer of the Senate shall inform the managers that the Senate will take proper order on the subject of the impeachment, of which due notice shall be given to the House of Representatives.

III. Upon such articles being presented to the Senate, the Senate shall, at 1 o'clock afternoon of the day (Sunday excepted) following such presentation, or sooner if ordered by the Senate, proceed to the consideration of such articles and shall continue in session from day to day (Sundays excepted) after the trial shall commence (unless otherwise ordered by the Senate) until final judgment shall be rendered, and so much longer as may, in its judgment, be needful. Before proceeding to the consideration of the articles of impeachment, the Presiding Officer shall administer the oath hereinafter provided to the members of the Senate then present and to the other members of the Senate as they shall appear, whose duty it shall be to take the same.

Until managers deliver the articles - the Senate cannot take action.

Yes both Judges are upstanding, in conservative eyes. Clarence has never got his soiled reputation by Anita Hill resolved. Folks still believe he did something. Non Trump and Non conservative folks still believe Kavanaugh did something to Blassie Ford. HOR were talking about trying to impeach Kavanaugh a little while ago. They are going for the President and now VP, next up they will circle round and try for Kavanaugh, especially if and when they take the Senate.

Typical DM adjective use. POTUS wasn’t _bragging_, he was characterizing the result accurately.

POTUS may wish for a clean win/exoneration, but with the progs, there is no way. They took their victory lap and he jerked their chain.

Accuracy to the progs is trolling to anyone else. Now, off they go, chasing the red light on the wall.

It is a trial, and the president is being tried for crimes. High crimes and misdemeanors at it were. I doubt anyone would have ever imagined a speaker would withhold the walking of the charges to the senate. The Supremes have not had to EVER rule on something so silly and basic. But since the issue has never been looked at by them...

And when I looked up subpoenas and congress there was a decision that the Supremes gave congress limited power to use them especially with private persons in their legislative function. This was in the 1920s. I don’t want to read much legal history, it is more boring than regular history. But it is not an enumerated power.
