Cruz: Senate Should Allow Trump To Call Witnesses In His Defense If He Wants To
RCP ^ | Date December 12, 2019 | Ian Schwartz

Posted on 12/13/2019 10:38:18 PM PST by conservative98

"My personal view is the House conducted a partisan show trial," Cruz said Thursday. "They denied due process. They didn't allow the president to cross-examine witnesses. They didn't allow Republicans to call witnesses. I think the Senate needs to do better. We need to respect due process. We need a fair proceeding. That means we need to let both sides present their case."

"If the president wants to call witnesses, if the president wants to call Hunter Biden or the whistleblower, the Senate should allow the president to call witnesses in his defense," the Senator said.

Keeping the pressure on.

Going to trial in the Senate and blowing open the entire Ukraine favorbribe system is Plan B.

Threatening to go to trial in the Senate and blowing open the entire Ukraine favorbribe system in order to get the Rats to abandon impeachment is Plan A.

IT’S A TRAP!

Call the whistle blower, sure.
Confront the accusers, absolutely.
Present/Discover the counter evidence to any evidence
presented, most assuredly!

Calling Hunter Biden, or other hostile witnesses,
NOT part of the Frivolous Impeachment attempt is a TRAP.
A FRIVOLOUS impeachment vote is a SEDITIOUS CONSPIRACY.
Prove the Seditious Conspiracy.

This is NOT the Right Trial for Hunter Biden.
He’ll get his turn(s), another time.

(I have some suspicion that Cruz knows this.)

Freaking SEDITIOUS CONSPIRACY members out with a few
Presidential “Trumping Tweets” is fair game though, I think.

Enjoy the show!

I think the Republicans in the Senate should use the rules of evidence as applied in court. Nobody questioned by Nadler had any direct evidence except perhaps Vindman. Then require Schiff etc to testify. If they don’t appear they are obstructing Congress. Short trial.

The Senate should dismiss this crap and acquit Trump without holding any hearings. There is nothing to be gained by calling witnesses. They will just attack Trump. If Trump wants vindication he can appoint a special counsel to investigate corruption in the Ukraine. The Democrats can use the house to investigate Trump, but Trump can't use the presidency to investigate them back? I don't get it. Time to go on the offensive.

exactly!

If Trump is reelected in 2020, there would be nothing to stop Democrats from pulling non-stop imeachment hearings into the future

That assumes the dims retain control of the House

Unlikely to zero.

“ Why is that even in question?”
*

Because $h!t happens that’s why. Let The Turtle handle this. Meanwhile, Trump should keep his mouth shut and work on treaties, the wall and such. If he plays his cards smart he will have a blowout re-election and add to senate and flip the House Republican....

I have become concerned about Lindsay Graham. He really does flip-flop and that makes me uncomfortable. The ONLY way this will be put behind us is for that trial in the Senate to take place, because the lies and the corruption of the Democrats, the FBI, the CIA or any Republicans involved in all that need to be exposed so that justice can be found. The American people, in the end, are the victims of all this. The dark secrets must be exposed. I will forever think that some big time alliances took place against this President if the trial he deserves does not take place. It will deepen the paranoia among us, the voters, about who we can trust. Right now, I trust only a handful of the younger conservatives in the House and Senate. The Swamp must be cleaned up and the disinfectant can only be found in that trial that our President wants. I want it and everyone I know wants it. Give us justice! Call out the rascals who have been hiding whose names we cannot know while they have printed the names, addresses and phone number of our brightest and best, putting them and their families in danger. It will be an outrage if our President does not get his day in court. It will allow the weaponization of the House of Representative against him to go unpunished. Please, Senators, for the sake of liberty for all, go forward with that trial. I don’t know what Senator Graham’s deal is but I do not like it. It is up to you, Senator McConnell. Please do it for the people.

I think there is merit to both arguments:

1) A quick dismissal or acquittal, if offered, is by far the safest way to ensure a win. These Republicans are lawyers, and are trained to manage risk and avoid uncertainty. And remember, this is not the same as “cutting a deal”, and pleading guilty to a lesser charge. They are not suggesting the President concede anything regarding the articles of impeachment. They also point out that a quick acquittal would not rule out the DOJ calling these same witnesses later as part of a separate Spygate trial.

2) On the other hand, the ability to call witnesses in a full impeachment trial would seem to be the perfect way of finally introducing the facts of the SpyGate scandal into the mainstream of public discourse, while importantly preserving the President’s “victim status”. As the defendant, President Trump would be able to legally turn the tables on his accusers while remaining inoculated from the perception that he is motivated by political retribution. Meanwhile, since he knows he is innocent, there is no risk of surprise evidence surfacing (at least not real evidence).

I can see merit in both arguments - and I do NOT think Mitch or Lindsey are sabotaging the President here or being gutless - they are just advising him to take the safer course.

Remember, none of the elements of their case are based on truth, so we know they will stop at nothing - we can’t rule out the possibility that given another bite at the apple, they could fabricate a piece of “evidence” damaging to the President.

After all, as Schumer said, the deep state has ways of getting you six ways from Sunday.

Much as I’d like to see these witnesses called, I see a lot of wisdom in scoring the quick win and calling it a day.

Immediately dismissing the charges won’t stop the communists from using impeachment clause for frivolous partisan purposes again in the future. The second time they do it for ludicrous reasons with Trump, the charges can be summarily dismissed because their credibility with the general public will already be exhausted.

Whatever the path to immediately destroy this threat is preferred. I don’t trust leaving this to the den of thieves in Congress.we all know most are owned pets of our enemies.

Outright dismissal of the threat is foolish.

Any tool that can be used to absolutely crush and humiliate the left and end this should be used, so long as it does prolong the exposure of the President actually being impeached.

I agree completely with my Senator from Texas.

This crap that Gramnesty wants to pull is only to cover the dead McCain's and his ass.

No, get to the person that issued the orders. As high up the food chain as we can get and put this shit to bed

Lindsey must have been told to stand down.

Maybe but probably for his re-election bid. He has lost points (?) to his dem opponent in the last week

If the senate votes to dismiss that will give the media and the rarts yet another cudgel to pummel Republicans.

Have a trial and allow Trump his due process and trust Trump to do the politically smart thing. He is very politically astute more so than any another Republican.

Trey Gowdy explained it well. The president has an easy win here. Take the win and then have someone else conduct an investigation. Gowdy was thinking senate judiciary, but I’m thinking a real DOJ attorney who can throw people in jail.

A Senate trial or a senate committee hearing cannot do that.

"Take the win."

That would be the simple thing to do but it does not drain the swamp. The libs and rinos have sung their hokey-pokey and now they need to tango!

Once Trump got the nomination Cruz has been solidly behind him. He wasn’t like Jeb, McCain, or Rubio.

No, they are going to have Lindsey, otherwise known as MISTER INVESTIGATIONS, handle it.

They are trying to put this in the closet under the clothes as quick as they can, because they are also corrupt.
