A man from Deerfield Beach, Florida, faces a potential of five years in prison after being convicted for defying the states red flag law, which allows authorities to confiscate weapons from those deemed to be at high risk of committing a crime. The case is the first conviction under the states relatively new gun law, which was passed in part as a response to the horrific mass shooting at Marjory Stoneman Douglas High School in Parkland, Florida.
Since the red flag law went into effect in March 2018, Florida has seized guns from over 2,000 residents of the state. But while the state has taken thousands of weapons, it has not convicted anyone for violating the law until this week. As reported by the Sun Sentinel, after being charged in March 2018 under the law for refusing to hand over his firearms, Jerron Smith, 33, was convicted by a Broward Circuit court this week on charges carrying as many as five years in prison.

And therein lies the problem.
Anybody can be accused of anything.
Someone could just go through the phone book and pick out names and blow you in and you're guilty until proved innocent.
Heck, then it's up to you to prove that you've never owned a gun even cause they'll just think you're lying and had gotten the guns illegally and are hiding them.
When the orders arrived at his home, Smith did not fully understand how far his rights extended, or more significantly, how far they did not, the Sun Sentinel reports. His defense lawyer, Jim Lewis, insists that Smith simply did not understand that the new law gave authorities the power to seize his weapons.
So it took a year for them to issue the risk protection order or they waited a year to enforce it. Something doesnt smell right or the story is incomplete.

Seems like the state is using this new law as a tool to selectively clean up behind its own questionable practices.

Red flag laws by their very nature violate due process, to say nothing of the Second Amendment. This guy should appeal it in federal court and bring it all the way to the Supreme Court. I am sure that he would be able to get financing from various gun organizations, and from a go fund me campaign.

Agree. But they didn’t need a “red flag” law to deal with this guy. And some judge will love to use this case to set “precedent”.
Florida has to now be crossed off the list of free states.

Rather then using the legal means that has been in place for hundreds of years. Showing he has lost his mind they want to use these cases as test cases. Or maybe they're far easier to implement then the old system?
