and who made the determination the guy wasnt fit to own a firearm?? and using what rational?? And therein lies the problem.
Anybody can be accused of anything.
Someone could just go through the phone book and pick out names and blow you in and you're guilty until proved innocent.
Heck, then it's up to you to prove that you've never owned a gun even cause they'll just think you're lying and had gotten the guns illegally and are hiding them.

Smith was arrested in 2018, accused of shooting at a car driven by a friend with whom he was having an argument over a borrowed cellphone, the outlet reports, noting that the victim was unhurt. In response, law enforcement officers issued a risk protection order requiring Smith to give up his weapons. When the orders arrived at his home, Smith did not fully understand how far his rights extended, or more significantly, how far they did not, the Sun Sentinel reports. His defense lawyer, Jim Lewis, insists that Smith simply did not understand that the new law gave authorities the power to seize his weapons.
So it took a year for them to issue the risk protection order or they waited a year to enforce it. Something doesnt smell right or the story is incomplete.

What Id like to know is why he wasnt in jail to begin with after spraying his friend and car with gun fire. Seems like the state is using this new law as a tool to selectively clean up behind its own questionable practices.

Red flag laws by their very nature violate due process, to say nothing of the Second Amendment. This guy should appeal it in federal court and bring it all the way to the Supreme Court. I am sure that he would be able to get financing from various gun organizations, and from a go fund me campaign.

Rather then using the legal means that has been in place for hundreds of years. Showing he has lost his mind they want to use these cases as test cases. Or maybe they're far easier to implement then the old system?
