Officer DEFIES Trump's Pardon For Eddie Gallagher And Sends His Case Before Military Board

A top Navy SEAL officer is defying President Donald Trump’s defense of Chief Petty Officer Eddie Gallagher by sending his controversial case to a military review board which could result in his ultimate expulsion from the SEALs.

On November 15 Trump reversed the demotion of Gallagher, a Navy SEAL who acquitted of murder this summer, and restored his title of Chief Petty Officer. The president also pardoned two other officers jailed for war crimes as well. 

Trump’s grant of executive clemency has been harshly criticized over violations of international humanitarian law.

Despite the Commander in Chief's pardon, Rear Admiral Collin Green, the head of the Navy Special Warfare Command, is taking the matter before a military board.

'This is a review of their suitability to be a SEAL,' an unnamed Navy officer said to CBS News, adding the review has the backing of both the secretary of the Navy and the chief of Naval Operations.

Totally agree. In this regard Trump is still living in a fantasy world where he truly believes everyone will come together for the greater good.

My biggest fear with former democrat and candidate Trump was that the Swamp would seduce him - cozy up to him and make deals that gave him something temporary that he wanted but in return cost us something permanent and priceless (gun rights near the top of that list). I suspect that would have worked if they had not completely lost any vestiges of sanity on Election Day. They want him humiliated and then dead, which is what they want for normal, decent Americans. Thank God that President Trump is still winning!

I retired in 07, contracted a few years, then worked University/mil research for another 7, my interactions were with O8and below, mostly. Had quite a few discussion about this issue. Never heard one say that they had to kiss ass, but hey, from your foxhole all senior field grade or GOs are patent Liars...

And there's the problem. A great many of We the People have lost confidence in the ability of OUR senior military officers to lead OUR military services which exist to defend and secure the liberty of We the People. The fact that senior "leadership" engages in chicken$#!+ activity in part drives this loss of confidence.

Rear Admiral Green was an Obama nominee.

One action is military justice domain, the other is administrative domain. Plenty of people have avoided punitive discharges only to be administratively discharged or relieved of specialty designations. It’s Charlie Sierra, but it’s legal.

I think this case is operating backwards. Administrative discharge may occur in lieu of courts-martial. I have not heard of someone getting an administrative discharge after being court-martialed, especially if the courts-martial punishment did not include discharge/dismissal. Wouldn’t there be a double jeopardy issue with such action?

As a 32 year retiree and knowing very little about the specifics here - I tend to agree with you. There are a lot of people weighing in here who don’t know how all of this works. The POTUS doesn’t get to decide who gets to be a SEAL - nor should he. I wouldn’t want Obama or Hillary deciding that.

From the article it sounds like Green is more worried about how the UN “feels” about the matter than his CIC. Do you think for a minute that Green consulted with the CIC before taking the action he did?

It doesn’t matter. I worked in the SOF environment for a very long time (until I was physically unable to - which is why I am 100% T&P & retired). There are certain things that happen that compromise your identity and clearances and if that happens - there are just things you can’t do any longer. It’s dangerous to you and your team. IT’s best that others who have first-hand knowledge make that determination - not the POTUS or anyone else.

Is being a Seal a Naval bunk apart from rank?
In a word, yes.

As with any military branch there is rank (enlisted E1 - E9, officer O1 - O11). Like any other service member there is a path through to different ranks. Time in service, skills assessments, duty stations (sometimes), etc.

And there is a rate in the Navy (MOS ( military occupational specialty) in other services), the job one performs.

SEALS can come from many rates. They gain an additional Special Warfare Operator rate upon completion of training.

If the President takes no immediate action against this clown then the Republic is over. This is not the first time for these clowns though it certainly is the most obvious. Of course it makes any revelation of Trumps orders to the LTC have less importance since clearly the military this they don't have to obey the CiC.

You’d think so, but no double-jeopardy. That only applies to being tried twice in a criminal proceeding after having been acquitted. A pardon wipes out the criminal piece but administrative proceedings arising from the same facts are not barred. The standard of proof is lower in admin actions (preponderance v. beyond a reasonable doubt). Ain’t sayin’ it’s right, just that it’s a fact.

I've got an inlaw who was an O-6 in The Corps. He was a regimental CO in Logistics at 29 Palms and LeJeune, until 2015. He'd had excellent Pro/Cons, or the officer equivalent, until 2012. He objected to the new "diversity" mandates he was ordered to implement. He saw, first hand, the Lesbian Mafia, a natural outgrowth of DADT, that could do what and who they wanted, since any objection to a lez picking out a different enlisted lover would run into a good chance of a "review" of his "sexual harrassment" conduct. He watched, with bitterness, the Obama teams move in and he was RIFed.

Made for interesting Thanksgiving conversations.

And I know, first hand, an ex O-4 who believes in chemtrails, and several other brands of nonsense, but he was Army, and I don't expect much from them. This is the bunch who let a flaming Communist go all the way through Hudson High...

The officer corp at the top of the US military is showing it is no different than their corrupt and tyrannical brothers and sisters in the rest of the US government. They fit right in with McCabe, Comey, Brennan, etc... The US military officer corp is just as corrupt and unethical as the rest of US government employees.

They will do what the elites tell them and if they tell them to wage war on US civilians who resist the destruction of the Bill of Rights they will no hesitate ordering American troops to fire on American citizens. The millennial generation is that generation President Reagan spoke of that was not taught about freedom and liberty and they will be the ones to give these priceless treasures away for the shinny trinket of it’s all free aka communism and they along with the rest of us will suffer with the death and spirit crushing misery that follows those who listen to the communist siren call of death.

The only hope we currently have to survive what is coming is if the grunts in the field refuse to follow what is clearly going to be a storm of illegal orders from their commanding officers. At CIA/FBI/DOJ/NSA all the other employees have rolled over and complied without so much as a whimper. I hope the grunts do not are our grand children will surely live in a communist America.
