White House and Pentagon prepare for Trump to issue pardons in war-crimes cases, officials say

WASHINGTON — President Donald Trump is expected to intervene in three military justice cases involving service members charged with war crimes any day, issuing pardons or otherwise clearing them of wrongdoing and preventing the U.S. military from bringing the same charges again, three U.S. officials said Thursday.

White House and Pentagon officials have been working out the details for days, said the officials, speaking on the condition of anonymity due to the sensitivity of the issue. The details were not all clear, but the move is expected to involve executive clemency, in which Trump can pardon someone or shorten a prison sentence through commutation....

...The cases include that of Army Maj. Mathew Golsteyn, a former Special Forces officer who faces a murder trial in the 2010 death of a suspected Taliban bomb maker; former Chief Petty Officer Eddie Gallagher, a Navy SEAL who recently was acquitted of murder but convicted of posing with an Islamic State corpse; and former Army 1st Lt. Clint Lorance, who was convicted of second-degree murder in 2013 and is serving a 19-year prison sentence for ordering his soldiers to open fire on three men in Afghanistan.

“Trump pardons war criminals” - you can see the CNN and MSNBC headlines already. They won’t even care that these are Americans, serving their country, who deserve the benefit of doubt. No, #trumpisworsethanhitler is so much easier to embrace - it requires no thought, no analysis, no questioning of their liberal orthodoxy.

My thought:

MAJ Golstyen has already been approved for the award of a Distinguished Service Cross, in limbo awaiting his court martial. I’m skeptical of the JAG argument, but I haven’t seen the evidence.

Petty Officer Gallagher. I am also guilty of posing with an enemy combatant who has ceased to be. I have the only copy of this photo . This is overcharged and is shameful.

1LT Lorance. I don’t know his case but LTC Allen West believes he has been improperly convicted and should be pardoned. I’ve talked to Allen and I support his position.

I would recall every general from that era, strip them of their pensions and give them a BCD and a 6 month stretch in GITMO, and fine them the amount of their pay from 2003 to their retirement date.
