After oral arguments, the fate of DACA and the approximately 670,000 immigrants who depend on DACA still appears grim though theres a slim possibility the Court could extend the programs life a little longer.
The legal question the Supreme Court considered was fairly narrow: Did the administration provide in a pair of memos an adequate explanation for ending the DACA program? There is actually little question that the administration could end DACA if it wanted to; the question is whether this administration took the correct procedural steps to do so.
Several of the Courts justices who are key votes asked questions suggesting that they are sympathetic to the Trump administrations position. And even if the Trump administration does lose this case, that loss is likely to be narrow.
Much of the argument, in fact, turned on a question of whether to require the Trump administration to file additional paperwork before it can wind down DACA. Based on the oral arguments, it may be possible to find at least five votes to keep DACA in place while the administration provides a fuller justification for its decision to end the program. Such a decision could buy some time for DREAMers (an umbrella term including immigrants with DACA protection), but in the end it still wont save DACA.
BUT
if you ignore the liberal perspective, he nevertheless provides a very good overview of the legal issues involved in the case.
Woo Hoo! Let the deportations begin.
One way or another the DACA kids will be staying.
Presuming the Court rules correctly (and, with Roberts on there, really, who the hell knows?) then DACA becomes a bargaining chip for Trump to try and get Congress to go along with reforms that he wants in our immigration law.
I wish it weren’t so, but he is Mr. Art of the Deal.
DACA never had any legal basis.
The GOP refused to sue to stop it before it got started because they wanted amnesty anyway they could get it.
If you let the DACA people (they are not kids anymore) stay then you will never deport their parents, uncles, aunts, cousins, etc.
Illegal aliens should ALL be deported.
Right! And bring a bucket for all the crocodile tears that will be shed along the way.
And Oh, By The Way, "dreamers" - just because you got away with being here illegally for years doesn't mean you aren't subject to being shown the door now.
That’s how the uniparty works. They pretend to fight each other but they all want the same thing.
And when Trump WINS this case, he should Immediately Rescind JFK’s Executive Order allowing Government Unions.
I’m just telling you that Trump is going to trade DACA amnesty for getting other things he wants in immigration law (reform of H1B, real funding for walls, etc.)
Reagan got schnookered in a similar circumstance so I’d advise against it. But mark my words, Trump will use this to try and cut a deal.
Just like the citizenship question.....Trump can do it, but not the way he is doing it.
This is procedural delay.
They pretend to fight each other...

And what is the chance of that happening in an election year?
Yep - he is a master at the art of the deal and also a realist...he’ll take 80% against an unattainable 100% and then did in for more progress.
When the odds would still be zero.
Kind of depends on whether Republicans could retake the House or not. If he dangles a deal in front of DACA kids they’ll become his top lobbyists for the deal.
Even Obama said it was illegal before he didn’t do it—it was an Obama high crime and misdemeanor.
Should the Supreme Court rule Trump cannot terminate Obama’s executive order circumventing the will of congress, it should logically follow that all legislative initiatives, proposals and prospective executive orders need to first go to the Supreme Court since they have in effect and by fiat assumed the constitutional role of congress and the executive branch.
My suggestion: Don't end DACA, just rename it - Deport All Criminal Aliens (DACA). If they are not here legally, send them home. No exceptions.
I’ll wait until the Fat Lady sings.
I have yet to read that part of the Constitution that says Illegal Invaders enjoy the benefits of American Citizenship.
I guess it’s in there somewhere like the Right to Abortion and the separation of Church and State.
