Just over a month after the Supreme Court effectively punted the partisan fight over gerrymandering to state courts, a North Carolina trial court has rejected state legislative district maps, saying lawmakers took extreme advantage to help elect a maximum number of Republicans.
The three-judge panel of state judges unanimously ruled Tuesday that courts can step in to decide when partisan advantage goes so far that it diminishes democracy. The judges gave lawmakers two weeks to try again.

State Rights suck sometimes.
This is what happens when you appoint or elect partisan judges.
Judges overruling the people that make the Laws
Of course the judges voted to expand their authority. Did we expect them to limit themselves? This is the problem with our government in a nutshell; elected officials seeking authority and granting it to themselves.
How is the Constitution not being respected? It's a state matter, state judges made the ruling, seems pretty straight forward to me. I can't believe that Republicans can't do the same to Democrats in New York, Illinois, and California.
We were afraid of this!
Supreme court has already ruled that the Judicial branch is not a proper venue to address this issue already. This ruling won’t make it to to the USSC level. The Supremes have judiciously determined that this issue is a state issue, IIRC.
I meant unelected officials.
Republicans in Illinois? All 8 of them?
L
Here in IL the Democrats did the same thing. Both parties cheat whenever they can.
“I can’t believe that Republicans can’t do the same to Democrats in New York, Illinois, and California.”
Well, I’m in Illinois, and the Republicans tried this and the Democrat-controlled state judiciary struck it down.
The Supreme Court says that it's perfectly fine.
The only fair way is to assign the districts by algebraic formula.
Isn’t this what Eric ‘the Red’ Holder has been promoting?
You realize this article is from Sept. 3, right?
In Arizona, a "non-partisan" commission was established by referendum.
"Non-partisan" members were appointed... who immediately drew districts to the severe advantage of the Democrats, and disadvantage of the Republicans, violating several proper procedures in the process.
It was upheld by the courts.
These were North Carolina judges doing this. Its actually the (federal) Constitution in action - states handling the local details.
That said, I dont agree with it either.
I don’t know. If so it might be his only good idea.
Then there will be fights over what algorithm to use. Same algorithm will have vastly different results in different states.
