It should be legal IMHO, but not by executive fiat. We have Congress for making and unmakingvlaws.

If Bernie could mandate this, think what else he could do.

Not too sure it’s actually a congressional law. I seem to recall it evolving from a tax issue to the present state of either your state legalizes it or they can play drug nazis at will.

Irrespective of the wisdom or lack of wisdom of making marijuana legal, he could do this.

Marijuana is illegal for public use under the controlled substances act which allows the dea to determine which substances are controlled or not. The dea being a part of the executive branch would be subject an EO.

The CSA really needs to be revoked and states need to take control of drug regulation. The dea should not be enforcing domestic drug laws or involved with regulating medical use of drugs. That’s for the States. Corruption can be better controlled at the State level because AGs can be voted out, individuals can leave corrupt states, and state record requests for government documents are much easier to obtain at the state level. Border control and customs should take the lead in interdiction because their role is better defined.

In fact dea is very corrupt because as a federal agency like fbi, oversight is and accountability is weak. Since its inception in 1970, we have only seen drug overdose deaths increase despite spending. billions. This war on drugs will never end for the dea because like all federal agencies, the incentives for the agents and bureacrats is too great to keep the money flowing and the pensions going. In fact, John Burke, a former top dea official has gone on the record about dea abuses such a bounties for taking down targets. Even though some big government boosters might like this idea, the problem is that these policies create perverse incentives to fabricate evidence and intimidate witnesses.

The Dems if they win will do it sooner

Feds don’t want weed cases unless there is money and assets to seize

He cant legalize pot in an eo, at best he could make an eo telling federal leos to not arrest people for,it, but that would probably cause a constitutional crisis scotus would have to deal with because his eo conflicts with a lawful law passed by congress.
