I realize it’s a different case, but I believe the issues are the same.

They are claiming he has no right to declare a state of emergency, and thus no right to redirect Pentagon funds.

Congress can dictate that funds can’t be transferred for other purposes under normal conditions, but once a state of emergency is declared, I think they lose the ability to block.

Seems to me any competent judge would have tossed this new challenge.
