Federal judge declares Trump border proclamation unlawful

A federal judge in Texas declared on Friday that President Trump's proclamation of a national emergency on the southern border is unlawful, blocking the plan to divert funding for a border wall.

Judge David Briones of the U.S. District Court for the Western District of Texas said in his opinion that the plan would be blocked after getting input from both sides in a lawsuit for the scope of an injunction.

The lawsuit was brought by El Paso County in Texas and a group called the Border Network for Human Rights.

Briones, who was appointed to the court by President Bill Clinton, ruled that Trump overstepped his authority to divert more funds to border security than what was appropriated by Congress.

He also ruled that El Paso has standing to sue the president and members of his Cabinet because the county "suffered reputational and economic injuries" as a result of the administration's rhetoric on the situation at the border and the construction plans that the proclamation entailed.

The 5th circuit leans right, so I expect the appeals court will slap this down faster than a Texas twister.

Imho, the Clinton 0bama judge is nutz. Neither Do El Paso Co., or a group called the Border Network for Human Rights have standing.

Plus SCOTUS has already ruled on the national emergency declaration and board wall funding.

Ignore the partisan hack judge.

Not at all. I’m happy to vote the Trump ticket in 2020. But we need to face the ugly truth that just voting GOP is not going to fix our problems.

The GOP has lied to GOP voters for 30 years about wanting a secure border, stabbed the American worker in the back with unfair trade, nominated liberals to SCOTUS, colluded with Democrats in the ongoing coup against POUTS, etc., etc.

We need an opposition party to the progressive agenda if this country is to survive. Right now we do not have one.

Liberal Prejudiced judges still saturate our judicial system. They are not beholden to the laws of the US Constitution. Every judge that rules contrary to their oath of office needs to removed immediately. That goes for any / all Politicians, especially those in DC Houses of Congress.

What we need to see happen NOW is for the Republican controlled Senate to fill the 107 VACANT Federal Judgeships with good TRUMP NOminees. I’m concerned that that goal is the furthest thing from where Lindsey Graham is now.

Among the VACANT District Court Judgeships are:

13 in New York State (of which 6 are in the Southern District of New York).

6 in New Jersey.

14 in California.

4 in Washington State.

Since he has been in office, President Trump has not been able to get a single District Court judge in those states confirmed—Thanks to LINDSEY GRAHAM and the Blue Slip process that he allows the DemocRATS to use as an unconstitutional VETO of Trump’s judicial appointment powers.

Can you imagine how much better things would be if the Southern District of New York included 6 Trump judges? Can you imagine if the District Courts in California included 14 young Trump judges whose names would be included when the random draws are made to assign Judges to new cases?

MR. GRAHAM, TEAR DOWN THAT ‘“BLUE SLIP” WALL!

I’m taking it as my personal jihad to scream this to the world. No more delay; fill the current judicial vacancies and all that follow — QUICKLY!

It should be obvious to anyone why the Democrats fight tooth and nail for every US Senate seat. It’s for control of the federal courts of this country. They can’t implement their extreme agenda on America without control of the federal courts!

This political hack in a black robe is saying the declaration of national emergency is unlawful. That was declared on 2/15/2019, almost eight months ago. A lots been done since then and this ruling makes little sense at this point.

My recollection as well.

So what’s up? We have a private party placing a lawsuit against the U.S. Government that aims to affect how tax receipts are spent. This, with a previous ruling by the Supreme Court that confirmed Trump’s right to spend it as he likes.

This is nuts. I must be missing something.

This judge is either corrupt or stupid.

Life, health, safety emergencies trump fiscal law. In fact one of the few situations that allows the government to obligate in advance of an appropriation.
