6th Circuit Orders Resentencing For Rand Paul Attacker
Daily Caller ^ | September 9, 2019 | Andrew Kerr

The 6th Circuit Court of Appeals on Monday remanded the lenient prison sentence given to the man who attacked Republican Kentucky Sen. Rand Paul on his property, finding that a federal district court lacked a “compelling justification” for sentencing him to only 30 days in prison. Rene Boucher was arrested in November 2017 for attacking Paul outside his Kentucky home after the senator blew some leaves into his property. Boucher entered Paul’s property and tackled him from behind, breaking six of his ribs and causing a pleural effusion, which ultimately led to pneumonia.

I found several articles on this subject but this was the clearest explanation of Boucher's "privilege" and why it should not have been considered by the district court.

Early senility?

Aggravated assault because of a few leaves?

Bizarre.

He should be facing the max sentence on an attempted 2nd degree murder charge.

Looks like there are some federal judges that are sane and have some common sense.

Rene Boucher should go to prison for 10 years.

This was a vicious pre-meditated attack.

I would not disagree, but, sadly, no one asked.

“A Kentucky jury in January awarded Paul over $580,000 in damages against Boucher.”

I don’t recall this part of the findings being in the news.

Occasionally I agree with Rand Paul’s positions on various topics and about the same amount of time I think he’s nuts.

That said, this clown coward that attacked him from behind got off too lightly. Period. In my opinion.

So glad to hear this. He’ll do 18-24 months in federal prison. Probably not PMITAP, but still federal prison.

Good. That sentence was ridiculous. He launched an unprovoked surprise attack on Rand Paul that caused serious injury. 30 days in the slammer was absurd. He needs to spend well over a year in prison.

I believe this sentence is a result of Boucher's criminal action.

Rand Paul did file against him in civil court for medical expenses, pain and suffering. See Rene Boucher for several short news articles about the situation from The Public Radio Service of Western Kentucky University.

Some Federal judges are sane and the rest are Carter, Clinton, and Obama appointees.

I’ll bet the light-sentencing judge was one of the latter & saw this as an opportunity for some SJW against a hated Republican.

So, a person of education, military service, and other considerations can commit crimes without punishment??

Gee, I guess we should all go out and rob banks.

You’re right. Boucher is an anesthesiologist with extensive experience in pain management, especially back pain. He made a downhill 60 yard charge at Paul, tackling Paul at the most vulnerable point when Paul wasn’t looking. That was a deliberate killing or crippling shot, not a lesser one, like a fist to the face.

No, no, no! The circuit court did an excellent job of explaining to the district court why Boucher's education, military service, standing in the community, etc. did not matter and should not be considered in sentencing the thug.

> Gee, I guess we should all go out and rob banks.

Based on this precedent, you can attempt to murder Senators and get a mere 30 days per. Less than 10 years total for wiping out the entire set.

LOL j/k. Laws only restrain us - the enemy is functionally immune to law enforcement and they know it.
