11th Circuit Poised to Lean Right With Trump Appointment as Judge Takes Senior Status

The U.S. Court of Appeals for the Eleventh Circuit will have a different makeup by March 2020, when Judge Stanley Marcus will have become a senior judge—along with the circuit’s longest-serving active judge, Gerald Bard Tjoflat.

The change means President Donald Trump will select two new judges for lifetime appointments. Tradition dictates that they should come from Florida, where Marcus and Tjoflat are based.

With two more appointments, Trump will have named five judges who will serve on the Eleventh Circuit for decades to come. That’s almost half of the court’s active bench, which will be made up of seven Republican and five Democratic appointees. Trump has already filled two Georgia seats and an Alabama seat.

What happens next will be “very consequential” for Florida, according to University of Richmond law professor Carl Tobias, who tracks and writes nationally about judicial nominations. Though judges are impartial figures bound by a code of conduct to avoid politics, their ideological leanings do leave a mark, the way Tobias sees it.

“I don’t think it’s any secret that most of Trump’s appellate appointments, and I think he would agree, have been extremely conservative ideologically, especially on culture war issues like abortion, voting rights, racial discrimination, capital punishment, those kinds of issues that do come up in the Eleventh Circuit,” Tobias said.

I believe this will be #44 and # 45 Appellate Court appointments for Trump, or 25% of All Appellate Court Judges.

Trump has already flipped two Circuits

They aren't judges until someone appoints them and confirms them. Before that they are just lawyers. No Trump is doing fine on the lower courts too.

Excellent! Obama appointed 4 judges to the 11th circuit and had it tied 6-6 for Democrat and Republican appointees.

Trump will get to name two more. One of those was a Ford appointee so that just holds serve but one was a Clinton appointee so that flips the 11th circuit from tied back to a majority of Republican appointees.

Obama appointed 55 to the circuit courts. Trump is around 45 so still a ways to go but he has mostly countered the damage Obama did.

This will happen, but again my pet peeve about “news” these days.

“poised to”
“about to”
“mulling”
“considering”
“thinking about” is not news.

When it happens, and the seat is filled, there will be news.

No knock on you Cotton. I just hate what has happened to so-called news these days that future possibilities are reported as facts.

I wish he would do something with the 7th in Chicago. Those handjobs just gave their blessing to a couple of local illannoy “assault weapon” bans, (Unfortunately, one of the yeas IS a Trump appointee...a female,)

Wow, figured this would be one of the later ckt courts to flip. Stanley Marcus is young by appellate court standards, a spry 72 or so.

The 2nd will flip shortly. The 10th has two D judges in their 70’s. Tick tock.

The 4th is 9-6 with two Clinton judges 80 and 77. When both go senior it flips.

The 10th is 7-5 with twot Rat judges 80 and 73. The first going senior makes it a tied court. Both senior flips it.

The turtle has a lot of flaws. But not on judges. Donaldus Maximus and Mitch jointed at the hip on major issue that most voters know deek about.
