“Rather than find clear and convincing evidence, [courts are] basically saying, ‘Better safe than sorry,’”

But, but, when I say “due process” it makes it sounds like I actually support the second amendment.

“does not implicate the second amendment, as it does not restrict the right of law-abiding, responsible citizens to use arms in defense of their homes.”

If the citizen who is red flagged is not law-abiding, arrest that citizen, don’t just take the firearms. If the citizen who is red flagged is law-abiding there is no reason to take the firearms unless “responsible” comes into play, but what does “responsible” mean here?

So the Elmer Fudds support red flag laws while the left is virtually swatting and doxing people for their political views... can we be that stupid!

Indeed. Why stop at guns? What if they have knives and vehicles they could murder with.

These laws go way beyond that scope of guns, but they handle it carefully for now on the booggeyman gun owner before moving on to other topics such as dissenting political views or mentioning the Bible about gay enablers going to hell.

“Better safe than sorry”

That’s what motivates most secret police forces.

Just consider:

“He voted for Trump” (racist deplorable!)
“He’s an NRA member” (terrorist organization!)
“He’s a combat veteran” (could go PTSD at any moment!)
“He’s a devout Christian” (bigot Islamophobe!)
“He’s a cisgender hetero male” (intolerant homophobe!)
“He hunts and fishes” (animal murderer!)
“He calls himself a `patriot’” (white nationalist!)

Yep, boys, better go kick in his door.

Do I exaggerate?

To the Elmer Fudds and legislator Rinos considering this cop shiney new toy witchHunt legislation:

However repressive the ruling regime is, however widespread lawlessness becomes, you never think that you, of all people, will be arrested. People tend to believe that the reckless automobile will plow into someone else, that the brick will fall on someone else’s head and that the undercover operative will come knocking on someone else’s door.

From what I see and hear when I am out and about, I think that your estimate is at least 20% low.

Government man: I’m here to buy back the guns we never owned with the taxes we took out of your paycheck:
Me: Due to your history of mass murders and violence, you failed my background check and you cannot be trusted with absolute power over the people.

The requirements for taking someone’s guns should be no lower than involuntarily committing someone to a mental hospital. And there MUST be stiff penalties for malicious false reports.

How can anybody confiscate anything when there’s no list of what they want to take?

I suppose if they’ve got a few years to search the 1200 acres of forest behind my house they can have at it.

Flimsey Grahamnesty should be removed from office just for his THREE amnesty votes, this is just one more example of him not siding with the citizens.

“And there MUST be stiff penalties for malicious false reports.”

Absolutely! Throw the f***ing book at anyone who commits felony perjury just to settle a grudge.

Only....the CA and CO Red Flag laws reduce the penalty for false official statements from a felony to a misdemeanor.

And anyone and I do mean ANYONE can denounce you anonymously to the po-po. Stalin is laughing in Hell.

But lets say you are falsely accused, like maybe you are accused of working with the Russians. What will come of the law enforcement agents making the false accusation? How much time and money will it take to defend yourself? They say they have protections in place and the courts will act with great care. This is the song that never ends.

Something like this is the sort of cornerstone that can open the way for the foundation of a defacto police state. Consider the implications - such laws can be used to run right past the protections enumerated in the 1st, 2nd and 4th amendments, at minimum. Dangerous, dangerous stuff. Civil liberties as we have known them are at mortal risk.

Probably whatever some unaccountable bureaucrat inhabiting the bowels of a government institution who weighs their decisions based on arbitrary political standards and not established legal ones says it is.

"I suppose if they’ve got a few years to search the 1200 acres of forest behind my house they can have at it."

It would take more than a few years, if there were bits of worn out brass or other metal scattered all over in the soil. ;)
