What kind of government is it called when judges pretty much dictate what a president can and cannot do and when they basically write law instead of just upholding it?

There has been some conjecture that Trump has used some Puerto Rico hurricane recovery money for border walls. Anyone know anything about this, and why there is about a $30 billion discrepancy between what Congress approved and what PR is supposed to have received? ALso why does Trump keep saying he has spent more than double in PR than what Congress has actually approved.
