Depriving a transgender inmate with severe gender dysphoria of sex reassignment surgery is a form of cruel and unusual punishment, a federal appeals court ruled Friday, affirming a lower court ruling.
The 9th U.S. Circuit Court of Appeals ordered the state of Idaho to provide the surgery for trans inmate Adree Edmo. The ruling is the first time an appeals court has ordered a state to provide gender-affirming surgery to a prisoner, and the decision is at odds with a ruling issued earlier this year by the 5th U.S. Circuit Court of Appeals.
Idaho's Republican governor, Brad Little, vowed to appeal the decision to the U.S. Supreme Court.
Edmo, who was featured in the Boise State Public Radio podcast Locked, repeatedly inflicted self-harm and twice attempted to castrate herself with a razor blade, according to court documents.
Responsible prison authorities were deliberately indifferent to Edmos gender dysphoria, in violation of the Eighth Amendment, the 9th Circuit ruling stated, adding it was established that "Edmo had a serious medical need, that the appropriate medical treatment was GCS [gender confirmation surgery], and that prison authorities had not provided that treatment despite full knowledge of Edmos ongoing and extreme suffering and medical needs.
Idaho's governor decried the ruling as extremely disappointing and said the state "cannot divert critical public dollars away from the higher priorities of keeping the public safe and rehabilitating offenders."

Not only does the 13th Amendment indicate that slavery, worse punishment by far than denying politically correct sex reassignment surgery imo, is acceptable punishment for crime imo, but the states have never expressly given the feds the specific power to deal with sex-related discrimination outside the scope of voting rights problems, evidenced by the 19th Amendment.
Section 1: Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted [emphasis added], shall exist within the United States, or any place subject to their jurisdiction.Section 2: Congress shall have power to enforce this article by appropriate legislation."

From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. And not only is this post-FDR era, institutionally indoctrinated federal judge unthinkingly interfering with 10th Amendment-protected state sovereignty, but by trying to give the referenced prisoner constitutionally indefensible protections, misguided judge is also effectively violating Founding States express constitutional prohibition on United States establishing protected / privileged classes imo.
"Article I, Section 9, Clause 8: No title of nobility shall be granted by the United States [emphasis added]: And no person holding any office or profit or trust under them, shall, without the consent of the Congress, accept of any present, emolument, office, or title, of any kind whatever, from any king, prince, or foreign state."
And since were still stuck with a worthless Congress left over from the lawless Obama Administration, all that we can expect Congress to do on this issue is to keep an eye on it while eating popcorn.
In fact, desperate Democrats and RINOs are probably happy to let judge get away with pushing politically correct LGBT rights.
This is why patriots need to elect a new patriot Congress in the 2020 elections that will not only promise to support PDJTs vision for MAGA, now KAG, but will also support PDJT to finish draining the swamp, especially the activist judiciary.

Being wise they became fools. Why would the taxpayers fund an unnecessary abomination? These “judges” dishonored themselves and their professional callings. They need to repent!
We live in a society where these judges feel safe to come down with decisions like this. Nothing is going to happen to them, even the barest minimum of someone they know mildly ridiculing them for this nonsensical dog squeeze much less any sort of removal from the court. It’s not even going to become a big story probably. Trump should just run stories like this and what they tried with Kavanaugh as campaign ads.
