Charge dropped against Central NY homeowner who shot, killed 2 intruders

UTICA, N.Y. -- A homeowner who shot and killed two intruders who police said were burglarizing his home in May has been cleared of any crime, his lawyer said today.

Ronald Stolarczyk, 64, had been facing a charge of criminal possession of a firearm, a felony, after he shot and killed Patricia Talerico and Nicholas Talerico as they were breaking into his Deerfield home. The homeowner’s handgun wasn’t registered as required by state law, authorities said.

The charge against Stolarczyk was dropped in Deerfield town court Monday night after the Oneida County District Attorney’s office made a motion to dismiss the charge and the judge agreed, Mark Wolber, Stolarczyk’s lawyer, told Syracuse.com | The Post Standard today.

Wolber said he has asked from the outset that the charge be dropped “in the interest of justice” and had numerous conferences with the DA’s office on the subject.

Today, Stolarczyk is “very relieved,” Wolber said. “He’s not a very emotional person, but is very happy this is over with.”

Patricia Anne Talerico, 57, and Nicholas A. Talerico, 27, of Utica - an aunt and her nephew - were burglarizing the home at 6110 Walker Road in Deerfield when they were shot by the homeowner, according to New York State Police.

Google up “Patricia Anne Talerico” and you’ll find her pix on gunmemorial.org

She had been arrested 20 times, but that site presents her as an innocent who was a victim of “gun violence”.

If she was arrested 20 times she probably committed 1,000 to 2,000 crimes. Each with another victim.

Surprising given that it's New York. In Massachusetts he would have gotten 20 years...and the families of the dead punks would have gotten a $50 million jury award in a civil trial.

I’ve known for a long time that they want to take guns from non-violent, honest citizens and deliberately leave them in the hands of violent criminals. They prove it every chance they get.

Do they even try to take guns from violent street criminals?

A Gofundme account was established for Mr. Stolarcyk to be used to defend himself. The fact that he could hire a competent lawyer probably helped his cause.

The gun owner should have never been required to register his weapon. What difference to the intruders would it have made if the gun was registered? They would still be dead. The DA recognized this so case closed.

The right to own a gun is granted by the U S Constitution and is the law in every state. The right to bear arms shall not be enfringed. Registration is an enfringment.

Letters from the public suggesting that the notion of jury nullification was not entirely eradicated from the minds of a potential juror pool and that consequently no likely jury would convict.

Poorly worded. “an aunt”: whose aunt? Since no one else is mentioned it would seem it was the shooter’s aunt (and nephew). Missed the “he didn’t know the intruders” part. Thx.

The right to keep and bear arms is recognized and protected by the U.S. Constitution. It is not granted by the document.

I agree, registration is an infringement.
