Judicial Watch announced today that it filed a lawsuit in Los Angeles County Superior Court on behalf of three California taxpayers to prevent the State from implementing Senate Bill 826. The 2018 law requires publicly-held corporations headquartered in California to have at least one director who self-identifies her gender as a woman on their boards by December 31, 2019 (Robin Crest et al. v. Alex Padilla (No.19ST-CV-27561)).Up to three such persons are required by December 31, 2021, depending on the size of the board. The lawsuit alleges that the mandate is an unconstitutional gender-based quota.
There are currently 761 publicly-traded corporations headquartered in California, the vast majority of which are subject to the legislations provisions. In a July 1, 2019, report, the secretary of state identified 537 corporations that fall short of the mandate.
Before the bill passed, a California Assembly floor analysis identified a significant risk of legal challenges to SB 826. It characterized the legislation as creating a quota-like system and noted, [T]his bill, if enacted into law, would likely be challenged on equal protection grounds
The use of a quota-like system, as proposed by this bill, to remedy past discrimination and differences in opportunity may be difficult to defend.
So California requires at least one psychotic person on corporate boards.

This is overtly discriminatory. It leaves out the 50-odd other gender identifications out there. Just ask Joe about it... if you dare.
It is. And USSC precedent exists in University of California v Bakke in 1978 that ruled racial quotas are unconstitutional. It is obvious then that quotas based on sex would likewise be illegal. California again. The left politicians don't learn from history they just repeat it until they win.
So if I read it right, if you have one woman on the board but she identifies as a man you are afoul of the law?

You are still O.K., if you can get one of the men to self-identify as a woman. :)
Great way to get companies to move their headquarters somewhere else. And, to discourage new headquarters from being located in your state.
Even if a corporation wants to bend to the PC ethos of the day and diversify its board by gender and race (most do), they’ve got to be put off by strict every day, all the time quotas handed down from the government.

Good grief. For the nominal $50k per year to be a board member I will, for the purpose of sitting on a board of directors, self-identify as a woman.

Gender quota? GENDER quota?? WTF?? Are they kidding? What if it’s a company that sells products only for men, personal items, you MUST have women on the board? Oh yes, I forgot, and transsexuals as well? THIS my friends is called tyranny, every one come take a look at what happens when leftists take absolute power over a state. Plastic straws BANNED! MS-13? Oh come right on in, we’ll protect you and give you free health care. You have a company? You better damn well fill the gender quota and we don’t give a damn if you can’t find any women who are qualified for your company.
