Sounds like they created this defense so the guy will get to spend the rest of his life in a mental hospital watching the birds outside instead of a state prison.
Because the real story was it was over a female relative of this man, I believe he was her uncle and did not want him near her for whatever reason. So they created this Trump conspiracy theory so they can get the guy look like he is crazy so he can spend the rest of his life in the crazy tank.

Recall the mobster who was whacked during a prison transfer. Corrupt government or security figures had to leak details of the transfer and permit the hit.
