legally, they have every right to play music.
fiscally, once you have installed speakers in the park, it really costs nothing to play music.

Our downtown area has put up speakers around their parks, and plays various music. During events, they will pipe in whatever live music is being featured. At christmas they risk attack by actually playing christmas music.
