9th Circuit blocks emergency funding for border wall, as White House vows appeal

The 9th Circuit Court of Appeals on Wednesday upheld an injunction barring the Trump administration from repurposing approximately $2.5 billion in Pentagon money to the Department of Homeland Security to build a border wall with Mexico, prompting the White House to promise an immediate appeal.

A divided three-judge panel on the appellate court agreed with a lower court ruling that prevented the government from tapping Defense Department counterdrug money to build high-priority sections of wall in Arizona and New Mexico.

In February, Trump ended a 35-day government shutdown after Congress gave him far less than he wanted. He then declared a national emergency that the White House said would free billions of dollars from the Pentagon.

In its ruling, the 9th Circuit panel noted that Section 8005 of the Department of Defense Appropriations Act of 2019 "authorizes the Secretary of Defense to transfer funds for military purposes if the Secretary determines that the transfer is 'for higher priority items, based on unforeseen military requirements' and 'the item for which funds are requested has [not] been denied by the Congress.'"

A circuit courts ruling doesnt cover the entire country.

I have no idea why anyone treats it like it does.

Aren’t there conditions under which a three judge panel’s decision would be forwarded to the full circuit court before going to SCOTUS?

Lets do kind of like Alaska did. We can take the money for the wall out of the Federal court budget.

But seriously the USSC should be obligated to return and settle this matter as it has been declared a national emergency. With Roberts on the Court- I am not hopeful however.

Wtf. He is the executive with mandate to protect the nation with the military. The court have no jurisdiction there. Zero zilch, nada. They could not stop a war in Afghanistan just as they could not have any jurisdiction over this

Since when can the courts rule on something done under a state of emergency? The emergency declaration specifically is going outside normal law. The only process for over-riding the emergency declaration is for Congress to over-ride it.

This was attempted and they failed. He should ignore this ruling. Or go Lincoln and arrest them right off the bench.

Whatever the merits of this decision, it must be said that no presidential administration has received this kind of treatment by the federal courts. From day one, these activists in black have thought of themselves as part of some resistance. Every damn thing gets blocked. The federal judiciary is entirely out of control. And liars like CJ Roberts like to pretend that these judges aren’t being political.

The legislative and executive branches have ceded and abdicated their constitutional responsibilities to the judicial branch.

We now have instant legislation written into law by black robed oligarchs. And apparently they are also empowered to write executive orders at will. While everyone meekly kneels at the alter of the bench. Disgusting.

The courts have no jurisdiction in this matter. It should be ignored, not appealed to the supreme court on bended knee.
