Roberts takes Dilantin, a seizure medicine. I took Dilantin for a dozen years until I got off of it and found my seizures were past history. Dilantin has mental effects and if combined with other drugs, the usual barbituates or antipsychotics, can be pretty severe. I lost gradually my will power, my power to resist bad directions from others. I suspect Roberts is susceptible that way to pressure from the Left unbalanced by pressure from the Right.Seizure medicine or any psychoactive drugs should be a disqualification for the Bench.

Roberts is proof of the establishment candidates (W, Clinton, Bush Sr, Obama) and how their picks for the court are often not what they claim to be so they can get on and do just this. Roberts was supposed to be a great conservative pick yet he has in seemingly purposeful fashion thwarted the court three times now by his antics. We need RBG to pass on and Trump to pick a new justice to end this crap from establishment types.

IANAL, but it sure looks to me like the Supremes gave President Trump an exact roadmap on how to get the question into the census. And they foreclosed the arguments the left used to get the whole thing considered in the first place.

All the commerce dept. has to do is make a reasonably plausible story about why they want to add the question, and if it involves administration policy the lower courts can not overrule it.

Sure, we have work to do, but with a little bit of planning we can get it done in time.

If that wasn’t bad enough, Chief Justice John Roberts cast the deciding vote along with the four liberal justices. Writing for the Court, Roberts agreed that Secretary of Commerce Wilbur Ross had the power and authority to add the question, but something just didn’t smell right.

The administration will probably come back with a good reason and the question will proceed on the Census. But even if that fails, what's the downside?
  1. If democrats are right, more illegals will answer the census giving a distorted and increased representation to those areas with lots of illegals.
  2. If the administration is right, there is a chance that minories could lose representation due to the distortions.
  3. Could we place illegals that have to be released in areas that dilute democrats votes?
  4. If more illegals answer the Census, Can we use other data to identify areas and identify ICE where illegals are residing?

If we could only win one of the major decisions, clearly the redistricting decision was the one to win and we did that in convincing style. I only wish now this court could get the gay marriage question back and use the same logic: marriage is a state issue for the states to determine themselves.

I have a question for the attorneys on Free Republic: Do appellate courts (i.e SCOTUS in this case) generally rule on facts of cases? I thought that was the purview of trial courts. It seems that the only part of Roberts’ opinion is that the law authorizes Secretary Ross to add the offending question to the census documents. The five moron majority’s opinion on Ross’s motivation should be irrelevant.
