The bottom line is that the liberal atheistic types, will still file lawsuits over this sort of issue, precisely because there was not a firm standard or precedent set up in this case.
The opinion went much further than that. There are five clear votes that Lemon is dead. Kavanaugh made that clear in his concurring opinion. Gorsuch and Thomas would go even further.
Roberts, Alito, and Kavanaugh all made clear that Lemon shouldn’t be relied on any longer in establishment clause cases across 5 broad categories (they are implicitly overruling Lemon because they five categories really cover virtually everything) and Gorsuch and Thomas would just Kill it dead.
Why? Because the conservative justices did not have the votes. Yet.
