They missed an opportunity to CLARIFY the rights of Christians when it comes to refusing to do business with entities when it violates their conscience and deeply held religious beliefs.
The end results -- MORE LAWSUITS against Jack Phillips.
is this a situation, in which there were not five firm votes to set a new standard, to abandon the Lemon test?
while this particular case was decided by a comfortable margin, there were differing justifications in the opinions.
The bottom line is that the liberal atheistic types, will still file lawsuits over this sort of issue, precisely because there was not a firm standard or precedent set up in this case.
The opinion went much further than that. There are five clear votes that Lemon is dead. Kavanaugh made that clear in his concurring opinion. Gorsuch and Thomas would go even further.
Roberts, Alito, and Kavanaugh all made clear that Lemon shouldnt be relied on any longer in establishment clause cases across 5 broad categories (they are implicitly overruling Lemon because they five categories really cover virtually everything) and Gorsuch and Thomas would just Kill it dead.
Why? Because the conservative justices did not have the votes. Yet.
Seriously, we’ve got to stop asking the supreme court to write law.
Remember?
The SCOTUS delivered a KO blow to social conservatives on homo marriage legalisation issue.
The Establishment can take their clause and shove it.
