The opinion went much further than that. There are five clear votes that Lemon is dead. Kavanaugh made that clear in his concurring opinion. Gorsuch and Thomas would go even further.
Roberts, Alito, and Kavanaugh all made clear that Lemon shouldnt be relied on any longer in establishment clause cases across 5 broad categories (they are implicitly overruling Lemon because they five categories really cover virtually everything) and Gorsuch and Thomas would just Kill it dead.
I am grateful that a majority of Supreme Court justices do not want to begin removing crosses from war memorials all across the country. But I am less grateful for their reasoning: these crosses have become so irreligious in symbolic import that they are no longer statements of religious conviction. As such, they do not violate the separation of church and state.
So, our culture has become so secularized that the crossa direct reminder of Christ’s death for mankind and an essential symbol of the Christian faithcan itself become secularized.
