Democrats defend asking nominees about Catholic faith, affiliations

Democratic senators on Wednesday defended their decision to ask President Trump’s Catholic judicial nominees about their beliefs, saying it’s fair to ask whether they can separate their religious faiths from their jobs as judges.

“It is never inappropriate for a member of this committee to ask whether a nominee for a lifetime position for the federal judiciary can rule fairly whatever their personal affiliations might be,” said Sen. Mazie Hirono, a Hawaii Democrat who’s frequently questioned nominees’ religious backgrounds.

The issue came to the fore Wednesday as the Senate Judiciary Committee held a confirmation hearing on Peter Joseph Phipps, a judge for the Western District of Pennsylvania who is now nominated to the 3rd U.S. Circuit Court of Appeals.

During his prior confirmation process for the district seat, Judge Phipps was prodded on his membership in the Knights of Columbus, the world’s largest Catholic fraternal charity.

It's one thing for Crazy Mazie to ask if a nominee can separate their religion from their job as a judge, quite another to continue to phrase questions implying that they can't.

JFK would have never won the RAT nomination today with the religious bigotry in his own damn party. My oh my. What goes around comes around. Catholics are not safe in the RAT Party these days!

Actually, they are (Biden, Pelosi). You just have to be the kind of Catholic that goes against basic Church teaching, particularly on abortion and sexual perversion.

There were concerns expressed in some circles that JFK would owe allegiance first to the Pope and then to the US Constitution. In response, JFK made numerous speeches arguing that he would be a President who happened to be Catholic rather than a Catholic President. The issue was first raised in the 1928 campaign of Al Smith.

As I previously posted:


I would love, for once, to see a nominee "take the sixth" and refuse to answer the question by invoking their Article VI protection against religious tests.

Each time the Senator pushes the question, the nominee should just declare "I am asserting my Article VI protection against religious tests and refuse to discuss the matter."


When the Senator persists, I would suggest replying with the following:

"How would you use my answer in your deliberations? You can't use it to disqualify me, so isn't it best that we don't even go there so there is no perception of taint in the confirmation process?

"Article VI is the same Article that requires the oath that YOU, Senator, swore to 'preserve, protect and defend the Constitution of the United States.' Why won't YOU defend my protection against religious tests?"

Sure they are. If it weren't for Catholics voting for dems...we might actually have won the house in 2018. The problem is - unfaithful Catholics and priests who apparently don't follow the rules of the church.
