Yes, yes, yes and a lower court judge has the authority to just make the determination that a higher court’s order is unlawful. Sorry but that isn’t how it works in this Country. How about he doesn’t like the legislature’s mandatory sentencing guidelines? Ahhhhh screw it! I’ll do what I want because I’m the arbitrator and decision point on what is unlawful and what isn’t! He doesn’t like a ruling? Well there’s a process for that and that is appeal; not activism in a court of law. But what does it matter because in the end he was wrong and lost his job as a result.
