The former chief of staff to Michelle Obama evaded a subpoena Wednesday from retired Illinois Appellate Judge Sheila OBrien. OBrien wants Tchen to hand over records related to her conversations with Cook County States Attorney Kim Foxx regarding the Empire actor.
Chicago attorney Tina Tchen who was in contact with Cook County States Attorney Kim Foxx before the charges were dropped against former Empire actor Jussie Smollett refused to be served with a subpoena on Wednesday, according to the process server.
Tchen, who previously served as former First Lady Michelle Obamas chief of staff, refused to accept a subpoena that was issued by former Illinois Appellate Judge Sheila OBrien.
OBrien is petitioning for the appointment of a special prosecutor to look into the states attorneys offices handling of the Smollett case. She is calling for Tchen to attend a May 31 hearing at the Leighton Criminal Courthouse and bring with her copies of any and all documents, notes, phone records, texts, tape recordings made or received at any time, concerning [Tchens] conversations with Kim Foxx in re: Jussie Smollett.
Edward Ryan, who operates a private investigation firm in the southwest suburbs, said one of his process servers went to Tchens law firm in River North on Wednesday, but she refused to come to the lobby to accept the subpoena.

Time for a bench warrant
Drop it at her feet and tell her she’s been served.
I guess he can do that since he worked for two Democrats who are obviously above the law, right, Nancy?
And you wont hear a peep about this in the press, no calls for her to be jailed, no conspiracy theory that the Obama’s might be involved in getting Smolletts case dropped since they are good friends with the Smollett family, nah of course not..only if this involved Trump would this be a big deal
Those who refuse service will eventually be served.
And in other news, judge ruled today that Smollett’s file will be unsealed, told Crimesha Foxx “act as if it had never been sealed in the first place”.
Jussie is the next Avenatti...
So the Obamas are involved in obstruction of justice.
Just wait by her car; sheesh.
If you have nothing to hide you have nothing to fear, right Cupcake?
Have a couple of State Troopers serve her.
Ground for disbarrment?
Color me shocked. Wouldn't be the first time. Or the hundredth time.
It certainly is, an officer of the court cannot refuse service.
Generally, service is accomplished at the front desk.
The front desk likely was warned that this had to be a personal service and then refused service.
In most cases, a defendant or target does not have to formally accept service in order for it to be considered effective.
If the defendant comes to the door but refuses the papers, the process server may just have to leave them at their feet and walk away AKA a drop serve.
This is no way to treat a judge.
