This is unconstitutional and it needs to be knocked down NOW. The day after a close election is not the time to fight this. If it came down to it, it would make the Bush/Gore Florida recount battle look like a game of checkers with grandpa. Do we want Roberts picking the POTUS? It was just blue states now but now have a blue leaning swing state. Fix this now.

It is a very bad idea but I doubt it is unconstitutional. The Constitution gives great deference to the States in the election of the president. That is by design, part of the federalist structure of the Founders intent. The original idea was for the president, limited in his powers, to be answerable to the States, not to the mass of people directly.

If any of the several States decide to appoint their electors by this system, they are empowered to do. To be sure, the Founders would be bashing their heads into their desks if they ever knew this hare-brained scheme had a ghost of a chance of being enacted.
