MILCON is MILitary CONstruction money.
The National Emergencies Act authorizes the President to re-program un-obligated funds from those accounts, for construction related to an emergency that the President may declare.
Those funds are appropriated for a five year period for projects, but the money is just obligated a bit at a time, as progress payments to contractors. So next year’s money is already sitting in the account (legally appropriated).
The House of Representatives intends to file a lawsuit when the Administration takes money from there - which should be coming up soon, after the easier money is spent.
