An investigation into U.S. Rep. Matt Gaetz will proceed, the Florida Bar said Wednesday, meaning the Panhandle Republican could face discipline for allegedly intimidating President Donald Trumps former lawyer Michael Cohen.
A grand jury-like panel called the Grievance Committee will next decide whether there is probable cause that Gaetzs tweet violated Florida rules for lawyers. Gaetz is licensed to practice law in Florida.
If the Florida Bar had determined in its initial review that discipline was not warranted, then the case would have stopped. But it has not, meaning the Bar has decided that further investigation is needed.
In moving the case against Gaetz to this step, the Florida Bar is also signaling that its initial review determined that the allegations against Gaetz would, if proven true, be a violation of the states rules for lawyers.

Being an attorney is a bit like being a real estate agent. That is, the first amendment doesn’t necessarily protect you. I remember being unable to say “homogeneous neighborhood”. And I understand saying “family room” is severely frowned upon.

I’m no fan of Cohen, but Gaetz’s Twitter post came across as juvenile and stupid.

Matt Gaetz was not acting in a role as an attorney, and there was no case in the Florida courts in which Gaetz was involved. His speech was political in nature and an attorney does not give up his right to free speech just because he is an attorney.
Gaetz needs to file a civil rights complaint against the Florida bar association, NOW.

I guess the Florida Bar never heard of the “speech and debate clause” in the US Constitution protecting the words of members of Congress.
